Subject: Formal Request for Access to Attorney’s Opinion on Board Election Eligibility
Dear Board of Directors,
We the Concerned Residents of Portsview at the Waterways Condominium Association, Inc., formally request a copy of the legal opinion provided by the association’s attorney concerning the eligibility of Ms. Victoria to run for the Board of Directors election.
This request is made pursuant to Florida Statutes §718.111(12), which mandates that condominium associations maintain official records, including legal opinions that pertain to the rights and obligations of the association and its members.
At the recent meeting, the Board referenced an attorney’s opinion as the basis for denying Ms. Victoria’s candidacy but has not provided residents with access to this document.
As unit owners, we have a legal right to review any records related to Board elections and governance.
If the Board intends to rely on this opinion as justification for disqualifying a candidate, withholding it from membership is a direct violation of Florida law and raises serious concerns about transparency and fairness in the election process.
Pursuant to Florida Statutes §718.111(12)(c), We hereby request that a copy of this legal opinion be made available for inspection and copying within ten (10) business days from the date of this letter.
Failure to comply will result in a formal complaint being filed with the Florida Department of Business and Professional Regulation (DBPR) for violation of access to records provisions.
Furthermore, should the attorney fail to comply with the release of the opinion in writing to the 544 residents of the Master Association, the residents will have no choice but to challenge the role and loyalty of the attorney in representing the interests of the full association membership.
The refusal to disclose a legal opinion that directly impacts the governance of this association suggests a misalignment of the attorney’s duties—one that appears to favor the Board and management company rather than the collective rights of the homeowners.
If the attorney serves the association, rather than selectively advising the Board, then it is expected that all unit owners have access to legal opinions that affect their rights and election processes.
Continued failure to provide transparency will likely lead to residents reconsidering whether the current legal counsel is truly aligned with their best interests and may prompt efforts to seek alternative representation.
We trust the Board and its legal representatives will act in good faith and avoid any further actions that could call into question their obligations to serve the community as a whole.
