POLICY CHANGE IN HOSPITALS NEGLIGENCE and MALPRACTICE !

The Issue

Has your family member(s) died in a hospital setting due to hospital Negligence, Malpractice.

Join our fight and let your voice be heard. 
Sign this petition for change in our healthcare system.

Letters are being prepared for the Senate and Whitehouse.  And we need this petition signed for change! 

Every 3rd Saturday a month we will meet for peaceful protest outside of  LongBeach Memorial Hospital 
corner of Atlantic / memorial care center at 5:30pm, bring a picture and signs if your loved one!

Hospitals need to take accountability in wrongful deaths, report to healthcare boards when they occur a “Never Event” in their hospital.

They don’t because they have to pay fines.

This petition is Not only to remember and honor my beloved husband, David Garcia who was only 41. 

This Petition is to also to bring attention to the grievous LACK of care and accountability in our hospitals.


The Man behind this Change

David Garcia 41, husband and father of 2  from Downey,Ca.

15 years in finance and did a sudden career change to work in the medical field finding his true Passion in helping others. 
 
Worked at Kaiser Permanente in Downey and was going to school at LBCC to start his new path in his career. 
 
One of the most friendliest and kindest souls on this earth. 

The Tragic Event 

David was a fighter, surviving a severe motorcycle accident that occurred June 4th as he was on his way to school to take his last final at Long beach city college and it happened to be the same day as our daughters 8th grade promotion, a Momentous day. 

Unfortunately he didn’t make it to school after the collision my husband was fighting for his life,
with 10 second response time of the help of good Samaritans, including an off-duty trauma nurse and a critical care nurse and Off-duty officer.

They revived him by performing CPR on him until his Pulse came back after 10 minutes. MIRACLE! I’m so grateful for these amazing people who came to his rescue. They waited with him until paramedics arrived and for him to be transported to Long Beach memorial Hospital.

 Of course, as soon as he arrived, he went into ICU. The trauma doctor told me that he had

  • fractured his left ankle
  • broke his right ankle
  • fractured his pelvis
  • broke his left wrist

June 16th Father’s Day 

trachea was placed(tube in his throat) they said he had obstruct sleep apnea “lazy tongue” when he’d be in deep sleep his tongue would block his airway.
So the purpose of it is so he can get proper oxygen to his brain and heart while he’s recovering. 

June 17th 

Feeding tube was placed. 

(because of his trachea a temporary peg tube was placed)
The first thing I asked when the Trauma doctor first came to me was were if his organs and his brain were OK and they said YES, he did have concussion from the impact, but there was no major brain bleed to where he needed to drain or need surgery.

We knew this was gonna be a road to recovery.

 Seeing as he’s never had any health issues prior. He was a strong 41 y/o.        My husband never even took medication he didn’t even have a cavity and no major organs damaged from the accident he would be healing from his bones. 


3 weeks of him in ICU and the doctors couldn’t even believe his recovery, his swelling and healing was going so good 

he was passing all the recovery milestones in his healing.


Physical Therapy (getting him out of bed having movement)
Occupational therapy (brushing his teeth on his own, feeding himself)
speech therapist (making sure he’s good on memory,passing swallow test (because of his trach)
so his rapid recovery from the accident was nothing short of a miracle, defying all odds and expectations in ICU overcoming the critical part of his recovery after 3 weeks in ICU

All nurses and doctors were amazing in ICU and ICU Stepdown and then we went to the 5th floor where he’d never come home.😭

On the evening of June 29th 

The doctors then placed David on the 5th floor because he was doing so well and all his healing and vitals were checking off as great. 

Our first night left the worst taste in my mouth. 
my husband was to have a 24 hour bedside sitter that was an order from the doctors monitoring him.

No sitter was there the first night. I stood by his side for a whole month I wasn’t gonnna leave especially that day

They had just given him stool softeners so he kept having the urge to have a bowel movement, he was getting restless. I asked the nurse to watch him while I took a quick 6-10 second pee break. She said yes and when I came back to him he was alone and his poop was everywhere all over him , on his catheter and also on calves of the orthopedic boots. 
I called for the nurse and no one was coming and I started recording.  I started cleaning my husband myself cause I couldn’t see him like that and I have the recording of his nurse walking in on me cleaning him and doesn’t offer to help and walks back out of the room. My husband the whole time telling me “I’m sorry for this babe, I’m embarrassed “ I assured him that I’d be there to take care of him no matter what. 

After that day I communicated about the level of care that happened to my husband and how I had never experienced such care since being there. 

As he was continuing his healing and the days became so much easier nurses were telling me to “go home and get rest” “go home we will take care of him”

and the Doctor confirming that he’d be getting his Peg Tube, and trach removed the next day

June 8th

I finally felt is was okay to come back home for 1st time in 34 days to be with our 14 year old daughter who hasn’t been home with both her parents and get some proper rest. But I felt so uneasy. And I couldn’t sleep. I would keep calling and checking on him.

July 9th 😭 at 3:27 Am

On Tuesday July 9th David Garcia  is pronounced Dead.

How??!!!
due to negligence at Long Beach Memorial. 

Unacceptable Circumstances

Why do these tragic events always seem to occur when family members are not present? 

The early morning call I received at 3:21 am after I just called to check on him at 2:44am.

Telling me he’s “peaceful sleeping”didn’t give me his Vital check like I requested over the phone continued to assure me my husband is “peacefully sleeping” the for them to call not even 30 minutes later me telling me of sudden change in David's condition, was a nightmare. 
When I arrived they told me he had a “Cardiac Arrest” . 

I knew that couldn’t be possible especially when the Doctors where saying he was getting ready for discharge and he was checking off all the boxes as far as Recovery and Vitals. And no past history with any heart conditions.

I prayed for the truth to be revealed, and what I discovered was absolutely unacceptable.

  • Wasn’t connected to Heart monitors (nurse were not alerted of any vital changes )
  • was given medication that wasn’t in his roster of medication to sedate him
  • was strapped down to the bed(he had no movement)
  • posey vest (chest strapped down to the bed(he’s never had that the whole time I was there with him )
  • wrist restraints 
  • feet restraints(on his 2lb each orthopedic boots) and they didn’t put in the medical report 
  • Mittens 
  • trach was capped (it was supposed to be uncapped while sleeping to get proper oxygen to heart and brain while sleeping )
  • bipap mask was one his face (he struggled with that on because his tongue would block his airway when in deep sleep) 
  • no accountability for a sitter by his bedside 
  • They deactivated my “MyChart”account when I got home after he passed
    (after I was told to my face that I can access his records and information on there) 
  • nurse said she walked in on him and seen him in the same position after 2 walk ins she touched his skin she felt him warm and walked out again but after my call was made she went in again and saw he’s in the same position then proceeded to say he looked pale and that when she checked his eyes and saw he was checked out and then called code blue

More families are coming forward saying their loved ones passed away from similar negligence at the same hospital and other Hospitals, nursing homes all throughout the Us. 

We need 

  • Policy Change
  • ”Every life matters Act”
  • Accountability from Nurses and doctors and upper management. 
  • proper patient ratios
  • New and enforced protocols
  •  well-trained healthcare staff to avoid mistakes and shortcuts.

Conclusion

The Name DAVID GARCIA , will not be forgotten.

This is a call for justice for David Garcia and for all future families who deserve better care.

We demand justice for him and for every family affected by wrongful death due to medical negligence. Let us advocate for patient safety and accountability.

If you see something, say something. Let David’s story and your loved one who was lost due the same negligence be a catalyst for change and justice. This is just the beginning as we’re in the infancy of his movement for change.

We will not be silenced! We have to fight and protect for our future loved ones and hospital workers that need help!
