The fight to overturn Luke’s findings has never stopped‼️
As you all know we have never accepted the findings into Luke’s brutal killing, and we have never stopped trying to have them overturned since they were handed down by email in OCTOBER 2024 suggesting suicide. Immediately we began looking for legal assistance as our stand in legal aid lawyer told us her scope did not cover appeals. Our original team were all promoted to District judges and a magistrate before the end of our case.
The reason it has taken so long is not because we have given up or failed to act. It is because getting legal assistance, to properly challenge what we believe are flawed and fraudulent findings with over 400 inconsistencies in the evidence, has been an exhausting battle in itself.
📌 We first approached LawRight, a government funded service, who took so long to review our application that we missed the 28 day limit to appeal direct. Two different lawyers then subsequently accepted our case but each ultimately backed out, wasting 6 months of our time.
When we publicly condemned this, Lawright then told us that a barrister had provided "advice" about our case without looking at any evidence, they even refused to disclose the barrister's identity or the barristers actual advice letter. Despite that, LawRight closed our file.
📌 We again had to search for assistance and Caxton legal, another government funded service, opened our matter in JULY 2025. We provided the full brief of evidence, albeit missing significant files that were still fighting to get, and our own extensive supporting material to the lawyer allegedly assisting us.
We were told that the matter was being reviewed and that advice would follow. Months passed. We followed up. More months passed. We followed up again.
In APRIL 2026, Caxton told us they still could not provide any advice yet or give us a timeframe or tell us what progress they’d made so far.
In JULY 2026, a year after they’d opened our case, we were told a different lawyer was actually assigned to our matter, not the one we’d been corresponding with all that time and this lawyer had now taken extended leave. They refuse to tell us the name of that lawyer and after more than a year of waiting and hoping and putting faith in them, believing they were working on our case, they tell us us there is no file to send, no work has been done. Caxton have referred us to a pro bono law firm instead.
So when people ask why the findings have not yet been challenged, the answer is simple…
We have been trying our very best, and we’ve been let down every step of the way!
We have spent years gathering evidence, identifying inconsistencies, challenging access to evidence, pursuing information through RTI, the information commissioner and QCAT, seeking legal assistance, approaching organisations and lawyers, and continuing to push forward despite repeated delays and setbacks.
The official findings state a version of what happened to Luke that is fundamentally wrong. Critical evidence was tampered, excluded, withheld, mischaracterised or otherwise improperly dealt with, and the conclusions reached do not withstand scrutiny.
📌 The findings are fraudulent and must be overturned.
But overturning findings of this nature requires a proper legal pathway and, unfortunately, we cannot simply walk into court and do it ourselves.
We have not stopped. We will not stop‼️
Luke deserves the truth and we will continue doing everything within our power to get it.
