On 24th March 2026 we had the first court hearing in QCAT - Queensland Civil and Administrative Tribunal. Here's what happened...

Gilbert v Whitsundays Regional Council and Queensland police for CCTV evidence in relation to Luke Gilbert:

  • Our subpoenas were denied! They were to clarify custody, access, and decision-making responsibility so that the Tribunal could determine whether the RTI exemptions were lawfully applied.
  • Whitsundays Regional Council applied for a time extension on submitting the CCTV footage after failing to submit on time due to staffing issues.
  • Whitsundays Regional Council requested non disclosure on CCTV footage.
  • Next hearing to be the same day as the hearing for obtaining the evidence in the prosecution of Constable Bryce Collins, 28th April.
