The Issue
Dear Fellow Changers,
Tevarez Lopez 38, Fairfield CA native who has been incarcerated for 2,1450 days as of December 22, 2021 due to unfortunate circumstances. Throughout the these years Tevarez and family has maintained and fought for his innocence with hopes of Senate Bill 1437 Constitutionally providing him way back to freedom that he truly deserves.
Tevarez’s Story:
Tevarez Richard Lopez was unlawfully convicted of murder on November 30, 2021, if the El Dorado County Superior Courts would have implemented Senate Bill 1437, Tevarez’s murder charge would have been dismissed, unfortunately Lopez was forced to trial and found guilty of a murder he did not commit in fact he was more than 150 miles away when the crime took place and there is no evidence what so ever that could’ve secured a guilty conviction. On record the presiding judge over his case stated that Lopez was not present, did not arm anyone at the crime scene and urged the district attorney to dismiss the murder charge under SB1437. During preliminary hearing the judge dismissed the special circumstance charge in regards to knowing about or arming the alleged principle with the firearm. Ultimately the district attorney refilled charges resulting in a jury finding Lopez guilty on the special circumstance charge although the judge acknowledged that there was no evidence what so ever that supported the allegations. Speculation does not constitute evidence and unfortunately the presumption of innocence is a legal myth justices moral compass and scale must be calibrated. Help green Tevarez Lopez an innocent cell dweller. According to the law SB1437 he should have been home several holiday and birthdays ago Lopez’s case is exactly what legislatures had in mind when SB1437 was enacted.
