We, the People of the United States, petition the United States Government, and the States, to implement the following Amendment II regulations in the Federal and State Code of Laws, for the protection of the People:

1. Definition: "Red Flag" List (if not already defined) - A list of individuals who may pose an immediate threat to any, or all, individuals in the United States by possessing (illegally), owning (legally), or attempting to purchase a firearm in any state with the intent to harm, or potential to harm, others and/or the self.  
2. All owners, and potential owners, of firearms in the United States must undergo an initial comprehensive psychological evaluation for record, and to purchase a firearm, and maintain re-evaluation once every 12 months, to be submitted through the licensed firearms distributor where an individual made their last firearms purchase, by the attending psychologist, for record of safety to maintain possession, and licensing, of firearms.
3. Details of the evaluation may be omitted by the attending psychologist in their report unless the individual evaluated agrees to release this information, or the attending psychologist believes the individual should be placed on a "Red Flag" list.
4. Those under a "Red Flag" would be required to relinquish all firearms until removed from the list by psychological evaluation.
5. Possession of a firearm by an individual who is under a "Red Flag" is to be treated as a felony with a minimum of 1 year of jail time and or all other applicable laws, and/or rehabilitation services, when applicable.
