We, the undersigned residents and concerned community members, formally object to any development on Erf 4470, Blouberg beachfront, unless full compliance with legal requirements for public participation, environmental oversight, and adherence to the property's title deed conditions is ensured.

Background:

Erf 4470, located along Blouberg’s scenic beachfront, is a unique and environmentally sensitive site. While building plans were originally approved in 2006 and 2008, minimal work has been done on the site, and the approval process did not take into account the current legal, environmental, and planning standards. The site has remained largely undeveloped for almost 20 years.

The property’s title deed also imposes specific legal conditions on what type of development is allowed. These conditions must be fully considered and respected before any construction begins.

Key Community Concerns:

1. Environmental Compliance: Given the site’s locatiion, any development must comply with the latest coastal management and environmental regulations. The community has not been provided with any updated environmental assessments or clarity on how the development complies with modern coastal protection laws.

2. Title Deed Restrictions: The property’s title deed restricts the land to commercial use only. Any change in use (e.g., to residential or mixed-use) requires a formal rezoning application and a full public consultation process, which has not occurred.

3. Impact on Infrastructure and Quality of Life: A development of this scale could significantly affect local traffic, parking, and public infrastructure. The community has not had the chance to provide input on the potential impacts of this development.

Our Demands:

- Ensure that updated environmental and coastal management assessments are conducted.

- Confirm that the title deed conditions are respected unless legally amended through due process.

- Guarantee full public participation in the decision-making process, including proper notification and consultation with the affected community.

- Ensure transparency regarding the impact on infrastructure and the scenic character of Blouberg.

This petition is a call for transparency, public participation, and the protection of our community’s environment. We urge the City of Cape Town, environmental authorities, and other relevant bodies to uphold the legal standards and ensure that this development does not proceed without proper legal review and community involvement.
