Petition to President Donald J. Trump: A Plea for Compassionate Waivers, Fairness and a Lifeline for US Refugee Resettlement Applicants from South Africa

To President Donald J. Trump, the White House, and the relevant United States authorities

We respectfully appeal to President Trump and his administration to consider the human consequences of refugee resettlement ineligibility decisions and to examine whether greater use of legally available humanitarian waivers, family-unity considerations and individualised review could offer a fair opportunity to applicants whose circumstances warrant compassionate consideration.

For those of us who have looked to the United States as a place of safety, freedom and the possibility of rebuilding our lives, refugee resettlement represents far more than relocation. It represents hope for a future in which we and our families might live without fear, with dignity, and with an opportunity to work towards a better life.

For some applicants, that hope has been extinguished by an ineligibility decision whose specific grounds have not been explained to them. The consequences are devastating. We are left trying to understand what happened, whether our circumstances were properly considered, and whether any opportunity remains to demonstrate that our individual situations deserve a different outcome.

We recognise that the United States has laws, eligibility requirements and security procedures that must be respected. We are not asking for those requirements to be abandoned, nor are we asking for automatic admission. We are asking for compassion to be exercised within the law wherever discretion exists, and for people not to lose the possibility of safety without a fair consideration of the circumstances that may matter to their cases.

Our central request is that the administration consider a compassionate waiver and review initiative for affected refugee resettlement applicants, wherever legally permissible.

US immigration law provides for waivers of certain grounds of inadmissibility for refugee applicants on humanitarian grounds, to preserve family unity, or when granting a waiver would otherwise serve the public interest. We respectfully ask that the administration examine whether applicants who may qualify for such relief are being appropriately informed, assessed and given a meaningful opportunity to present relevant circumstances.

We understand that not every ground of inadmissibility can be waived and that not every applicant will qualify. Our plea is that legally available relief should not be overlooked where an individual's circumstances merit consideration.

Our experience has also highlighted the difficulties applicants can face throughout the resettlement process. We have endured lengthy periods of uncertainty, difficulties travelling to attend required appointments, and the emotional strain of placing our hopes for safety in a process over which we have little control. Despite progressing through multiple stages, attending our interview and complying with the process as required, we received notice that our case was ineligible for continued processing without an explanation of the specific grounds for that decision. We were informed that the decision could not be appealed, leaving us without a clear understanding of what led to this outcome or how any possible error could be addressed. The absence of meaningful answers has compounded the distress of an already difficult situation and left us fearing for our future, with no clear path forward.

We are also concerned that people should not be reduced to a single aspect of their history, personal circumstances, affiliations or past conduct when decisions are made that will determine the course of their lives. Among those seeking resettlement are people who have worked, raised families, served their communities and tried to live according to their values and responsibilities. We recognise that eligibility requirements and security considerations must be respected, but we believe that decisions with such profound consequences should be based on a fair and careful assessment of individual circumstances. A person's life, character and circumstances are more complex than any single detail in their history.

The emotional consequences of these decisions must not be underestimated. For people who have spent years hoping for safety, only to have that possibility taken away without a clear understanding of why, the resulting despair can be overwhelming. Some feel trapped, abandoned and unable to see a viable future for themselves or their families. We are deeply concerned about the toll that prolonged uncertainty, fear and the sudden loss of hope can take on people's mental and emotional well-being. We ask the administration to recognise the human urgency of these circumstances and to consider whether compassionate waivers and meaningful review, where legally available, could offer a lifeline to people who feel they have run out of options.

We respectfully ask President Trump and the United States Administration to consider the following requests:

1. Compassionate waivers: Examine whether a process can be established or strengthened to ensure that applicants eligible for legally available humanitarian waivers receive appropriate consideration of their circumstances, including family unity and the public interest.

2. Individualised consideration: Where the law permits discretion, consider the full circumstances of the individual, including the nature and context of the conduct or issue giving rise to concern, the person's history, evidence of rehabilitation where relevant, family responsibilities and the consequences of refusal.

3. Transparency: Provide applicants with an understandable explanation of the grounds for an ineligibility decision to the extent permitted by law, so they can understand the outcome and whether any lawful remedy may be available.

4. Meaningful review: Consider an appropriate mechanism for examining cases where applicants believe relevant evidence was overlooked, circumstances were misunderstood or a legally available waiver was not adequately considered, consistent with applicable law.

5. Family unity and humanitarian concerns: Give appropriate weight, where legally relevant, to the consequences for families, vulnerable individuals and dependants when exercising available discretion.

6. Fair and consistent procedures: Ensure that applicants are appropriately informed of any waiver process available to them and have a fair opportunity to present relevant evidence before a final determination is made where the applicable procedures permit it.

Behind every case number is a human being. Behind every family application are people who have placed their hopes in a process they believed offered a genuine possibility of safety.

For some, the loss of that possibility brings uncertainty about where they can safely live, how they can protect their children, and what future remains available to them. They may have limited resources, significant personal vulnerabilities or no realistic means of obtaining independent legal assistance. For those who fear the consequences of remaining in their country of origin or current circumstances, an ineligibility decision can feel like the closure of the only door through which they believed safety might be possible.

We ask that these human consequences not be overlooked.

We are not asking the President to disregard the law or to grant every application. We are asking that the law's existing humanitarian provisions be given meaningful consideration in cases where they apply, and that an otherwise eligible person not be denied the opportunity to seek a waiver simply because their circumstances have not been fully understood.

A fair process must be capable of recognising both legitimate security concerns and the individual circumstances that may justify compassionate relief. These principles need not be in conflict.

We respectfully ask President Trump to hear our plea, direct the relevant authorities to examine these concerns, and consider whether a compassionate pathway can be made available to affected applicants wherever the law permits.

We ask for no special privilege. We ask for the opportunity to be heard, for legally available compassion to be considered, and for a fair chance to demonstrate that our lives and circumstances deserve more than a final decision we do not understand.

For those of us who still hope for safety and a future for our families, a compassionate review could mean the difference between the complete loss of hope and the possibility of rebuilding our lives.

It could offer a lifeline to people who are struggling to see a future, and restore the possibility that a difficult circumstance or a single finding need not define the rest of a person's life.

Thank you for your consideration.

Signed by concerned refugee resettlement applicants, their families, supporters, and members of the public who believe that fairness, accountability and human dignity matter.
