Subject: Amendment to the Live Local Act to Permit Development of Low-Income Affordable Housing on T3-Zoned Properties
We, the undersigned, respectfully petition the Florida Legislature to amend the Live Local Act to allow for the development of low-income affordable housing on T3-zoned properties.
Background
The Live Local Act was enacted to address Florida’s growing affordable housing crisis by incentivizing and facilitating the development of workforce and low-income housing. However, current zoning restrictions in many municipalities, particularly the limitations placed on T3-zoned properties (low-density residential zones), prevent the effective implementation of these goals in areas where affordable housing is most needed.
In the City of Miami, there is an abundance of T3-zoned lots that are not in use and cannot be developed due to restrictive zoning regulations. These underutilized parcels represent a missed opportunity to create much-needed affordable housing in areas that already have established infrastructure and access to public services.
Issue
T3-zoned properties are currently restricted to low-density residential use, which severely limits the potential for developing much-needed affordable housing. Many of these properties are in prime locations with access to essential services, employment opportunities, and public transportation. Restricting their use for low-income affordable housing perpetuates socio-economic disparities and exacerbates the ongoing housing crisis.
Proposed Amendment
We propose an amendment to the Live Local Act that:
Allows for the construction of affordable housing developments on T3-zoned properties by permitting increased density for projects that dedicate a significant percentage (e.g., 50% or more) of units to low-income households.
Provides incentives such as tax credits, grants, or expedited permitting for developers who commit to constructing affordable housing within T3 zones.
Encourages municipalities to adopt zoning variances that support affordable housing initiatives within residential neighborhoods while maintaining community character.
Ensures sustainable development practices by integrating green building standards and transit-oriented development policies to enhance livability and accessibility.
Why This Amendment is Necessary
Addresses Housing Shortages: Expanding affordable housing into T3 zones would provide more options for families, seniors, and essential workers struggling with housing costs.
Enhances Community Stability: Affordable housing developments in mixed-use residential neighborhoods help prevent displacement and create more diverse, economically vibrant communities.
Utilizes Existing Infrastructure: Many T3-zoned areas already have necessary infrastructure in place, reducing the burden on municipalities while efficiently using land resources.
Unlocks Underutilized Land in Miami: Amending zoning laws will enable the development of currently unused T3-zoned lots, maximizing their potential to serve the community.
Aligns with Florida’s Growth and Economic Needs: A more inclusive approach to zoning will help Florida retain its workforce and support economic growth.
