The current extended duration, often spanning 5-15 years, significantly hampers the individuals involved in rebuilding their lives. This change is crucial to provide both parties with a fair chance to restart their lives promptly.  

Proposed Amendment:

• All contested divorce cases should be resolved by the court within a maximum of 2 years from the date of the first hearing.

 

• This timeframe allows adequate time for reconciliation efforts and, if unsuccessful, ensures a fair chance for both parties to move forward.

Rationale:

• Timely Justice: Prolonged legal battles add emotional and financial strain on individuals. A two-year limit ensures a more efficient judicial process, providing closure to affected parties.

 

• Opportunity for Reconciliation: The proposed timeframe allows a reasonable period for reconciliation efforts, promoting the preservation of marriages where possible.

 

• Facilitation of New Beginnings: Shorter legal proceedings enable individuals to rebuild their lives sooner, fostering a healthier transition for all parties involved.

 

• Emotional Well-being: Lengthy divorce proceedings adversely impact mental health. A time-bound resolution minimizes emotional distress, enabling individuals to focus on their future.
