My mother passed away, and I was devastated. Despite being her child, I was not allowed to attend her funeral or even access information about the arrangements. A select few family members, who were involved in organizing the funeral, told others not to share any details with me. Because of this, I was unable to say goodbye, grieve properly, or participate in honoring her memory. The pain of being excluded from such an important moment has stayed with me, and I believe that no other child—regardless of age—should be denied the right to be informed or to attend their loved one's funeral. We, the undersigned, are calling for the urgent enactment of "Merles Law" to address a critical gap in current legal protections regarding the rights of children of the deceased.
Background:
Losing a loved one is an emotionally devastating experience. Unfortunately, many children—regardless of age—are unfairly deprived of the opportunity to be involved in funeral arrangements or to attend memorial services due to restrictions or lack of access to vital information. Such limitations can cause lasting emotional pain and hinder the grieving process.
Proposal:
"Merles Law" aims to establish that:
All children of the deceased, whether minor or adult, have the legal right to be informed about the death and funeral arrangements.
All children have the right to attend funeral services and memorial events to grieve and honor their loved ones.
Legal safeguards will be put in place to prevent restrictions or exclusion by family members or others who seek to limit access to funeral information and attendance based on age or relationship.
We believe that respecting the rights of all children during times of loss is essential for emotional well-being, closure, and healthy grieving.
