Sub – Application for coverting the Bailable Offence into Non-Bailable Offence, which is mentioned in Section (325) of BNS Act.

 

Respected Sir,

I would like to do this Application for the BNS Act Section (325), those effective from the 1st July, 2024 to the whole of India.

 

1. That this application for coverting the Bailable Offence into Non-Bailable Offence, which is mentioned in Section (325) of BNS Act and, those applicable from 1st July, 2024 to the whole of India.  

2. Article 21 of COI :- It’s a very wide Concept/Interpretation, this shall also includes to the “any living Organisms”, and, all the living organisms has the right to life, which means it includes the Animals. 

3. Article 48A of COI :- It clearly states that the State has the duty to provide the safeguard to the Environment and the Wildlife.

4. Article 51A(g) of COI :- It clearly states that the, people have the Fundamental Duties to provide the safeguard to the Environment and the Wildlife.

5. Environmental Impact :- That the Non-veg, directly or indireclty impacts on the Environment, there are several studies had been also done on this, and in all these studies, Prima-Facie clearly shows that the meat consumption is direclty or indirectly impacting on the our Environment, and it also directly or indirectly affecting the Eco-system of our Nation.

(i) Environment Impact on Plant-Based Diets: How Does Organic Food Consumption Contribute to Environmental Sustainability? (2020) by de Dore et al., 

Result :- Participants with diets rich in plant-based foods (fifth quintile) were more likely to be older urban dwellers, to hold a higher degree in education, and to be characterized by an overall healthier lifestyle and diet. A higher provegetarian score was associated with lower environmental impacts (GHG emissionsQ5vsQ1 = 838/1,664 kg CO2eq/year, −49.6%, P < 0.0001; CEDQ5vsQ1 = 4,853/6,775 MJ/year, −26.9%, P < 0.0001; land occupationQ5vsQ1 = 2,420/4,138 m2/year, −41.5%, P < 0.0001). Organic food consumption was also an important modulator of the relationship between provegetarian dietary patterns and environmental impacts but only among participants with diets rich in plant-based products.

(ii) The EAT-Lancet Commission on Healthy Diets From Sustainable Food Systems** (2019) by Willett et al.: This report, published in The Lancet, outlines dietary guidelines that promote human health while also considering environmental sustainability, including reduced meat consumption as a key recommendation.

These studies provide insights into how meat consumption contributes to greenhouse gas emissions, land degradation, water use, and other environmental impacts. They also discuss potential solutions and dietary shifts that could mitigate these effects.

6. Supreme Court :- In the Judgement of Animal Welfare Board of India v. Nagaraja and Others. The Supreme Court expressly decided on Article 21 in favour of animals. The Apex Court ruled that every species has a legal right to life and safety under the law of the land.

Environment :- Environment, which means it includes the Animals.

Animal :- Animals, which means it includes all the living organisms other than  human being.

 

PRAYER

1. I, kindly request you to covert the Bailable Offence into Non-Bailable Offence, which is mentioned in Section (325) of BNS Act.

2. I, kindly request you to take the appropriate and necessary decision/action on the Animal Killing, in the interest of the Environment, Wildlife, Eco-System and Speechless Animals for the better future of our Nation.

3. I, kindly request you to take the appropriate and necessary decision/action on the Animal Killing, in the interest of mitigating the affect on the Eco-system of our Nation.

4. Kindly, take all the necessary steps or actions in the interest of justice for the Speechless Animals or our Environment. 

 

This above-mentioned Application for the Interest of Providing Safeguard to the Speechless Animals, those diectly or indireclty imapacts on the our Environment, Eco-system, Humans Behaviour and our Nation.
