Petition for California Victim Advocate and Justice System Reform

The Issue

    We, the undersigned, call for immediate reforms to the California Victim Advocate system and the broader justice system to ensure that the rights of victims are upheld and that justice is served fairly and impartially.

Background
Recent cases have highlighted significant failings in the treatment of victims within the California justice system. These failings include:

  • Violation of Marsy's Rights: Victims' rights to be heard and to have legal representation are being disregarded.
  • Prosecutorial Misconduct: Numerous instances of prosecutorial misconduct, including the rejection of legitimate cases with admissible evidence and the malicious prosecution of innocent individuals.
  • Lack of Legal Support: Victims are often left without legal representation, particularly when they recant statements or are subpoenaed to testify in court. 
  • Neglect by Victim Advocates: Existing victim advocate programs do not adequately support victims seeking to challenge prosecutorial decisions or pursue legal recourse.

Our Demands

We demand the following reforms to ensure that victims' rights are protected and that the justice system operates with integrity and fairness:

  • Mandatory Appointment of Free Legal Counsel: Courts must appoint a free lawyer for all victims before any court testimony, to protect their Marsy's Rights and guard against self-incrimination.
  • Expansion of Victim Advocate Programs: Victim advocate programs must provide comprehensive support to all alleged victims, including assistance in obtaining legal representation regardless of testimony status.
  • Accountability for Prosecutors: Implement strict measures to hold prosecutors accountable for misconduct, including the malicious prosecution of innocent individuals and the rejection of cases with legitimate evidence.
  • Prohibition of Subpoena for Victims: Legislation should be enacted to prevent District Attorneys from subpoenaing victims to testify, ensuring that victims are not forced to participate in the prosecution without their consent.
  • Transparency and Oversight: Establish an independent oversight committee to review cases of alleged prosecutorial misconduct and victim rights violations, and ensure that victims have a clear avenue for reporting and addressing these issues.
  • Support for Recanting Victims: Provide resources and support for victims who recant their statements, ensuring that they are not discredited or presumed to be lying, and that their rights are fully protected. Assuming a recantation is false without strong evidence or medical documentation and full context is unlawful. It is unlawful to disregard victims' rights regardless of recantation.
  • Unbiased Support from Victim Advocates: Victim advocates must assist all alleged victims without bias or discrimination, regardless of the circumstances. They must also support victims seeking help when DAs or courts violate their rights.
  • Free Legal Representation Through Advocate Programs: Free lawyers should be available to victims through victim advocate programs to ensure constitutional and victim rights are upheld. This representation is crucial to hold prosecutors accountable for misconduct in court.

Call to Action

We urge the Governor of California, the California State Legislature, and the California Department of Justice to take immediate action to implement these reforms. The rights of victims must be not just written in law but are actively upheld in practice.
