Dear Hon Mischin, Thank you for your letter date December 2015. I note that it has taken over 18 months for your reply, which has contributed to the “long history” which you mentioned. You made reference of the “extensive history of investigation” referred to by the Premier Mr Barnett. In particular the investigations of Senior Sergeant Warner and Detective Constable Lilley. It is no surprise that an investigation by police into police finds no misconduct by police. However the Police's own Senior Solicitor noted “a confused and apparent lack of understanding by both the police and the BEC security officers of the legislative parameters surrounding the Casino Control Act, the Criminal Investigation Act and the Liquor Control act which appears to have contributed to quality of the investigation” in these reports. This was pointed out by the Premier himself. The reports are also in conflict with the opinions of Magistrate Lawrence and the Parliamentary Inspector to the Crime and Corruption Commission, Hon Michael Murray QC. The 'extensive investigations' do not even match the CCTV evidence of the crime. The reports are a joke. They have been written to convince the average, unquestioning public servant that a thorough and fair investigation has taken place. This is far from the truth. It is clear that an independent (of police) investigation should be done to get an independent result. You refer to the 'protection against external interference in the role of police as prosecutors in the criminal justice system.' Police however have given no valid legal reason not to prosecute. Rather they just don't want to prosecute. All police officers in attendance that evening stated they knew the Casino Security staff who assaulted me. How nice it would be to have a friendly police office that could waive criminal charges without legal explanation and be unchallenged. And surely the police could enjoy a friend in the Casino. This is the system you are advocating. In a meeting with Senior Constable Greg Glossip of Police Complaints, be bragged that under self regulation, Police had become untouchable and were even above the Corruption and Crime Commission. History has shown absolute power corrupts absolutely. The police state didn't work for Hitler and doesn't work now. Western Australia has become a Police State. The right of citizens to challenge the police has been removed. The only hope rests in the Corruption and Crime Commission ordering a review of police action under section 3 of the Crime and Commission act. You can help make this happen.
