UPDATE: Legal Challenge to Town Hall Site Project Moves Forward
A new court filing has been submitted in our community effort to ensure proper environmental oversight for the Brighton Town Hall improvement (McGarry v. Town of Brighton).
Here’s where things stand:
🌳 What’s at Stake: The lawsuit focuses on key environmental review decisions—specifically the expansion of parking, changes to drainage, the removal of mature trees without Conservation Board approval , and how current construction limits future recreational amenities on the campus.
⚖️ The Latest Court Action: The Town asked the court to dismiss the case, claiming it was filed too late and would cause unfair delays. Our legal team just filed a formal response arguing that:
- The challenge is timely — filed directly following the Town’s May 18, 2026 resolution that finalized the site layouts and tree removal plans.
- Environmental reviews are incomplete — key decisions were made on still to be completed designs, leaving major questions about unwarranted parking causing the loss of trees, loss of canopy, and loss of green space.
- Our goal is responsible oversight — we are not asking to remove finished work or cancel contracts. We are simply asking the court to require the Town to complete the legally required environmental assessments before moving forward with remaining work including recreational amenities.
📅 What’s Next: The Town's motion to dismiss will be fully submitted to the Court by October 22, 2026. If the judge denies their motion, the Town will have to submit its full administrative records for review.
Stay tuned for a decision on the Town’s motion to dismiss! 💬 Feel free to share this post with interested neighbors.
