Please stand with me to get justice for my fiance
The Issue
My partner has been incarcerated since January 2019 because my sister made a false allegation of sexual assault. She is very jealous of our lives so she was trying to hurt me. Then 6 months later after the crown offered het a peace bond she had her daughter lie and say that he touched my daughter. The police interviewed her and she did not mention anything at all about him being inappropriate. I was home the evening she alleges it to happen and he did not touch her.Yet they still charged him. She just didn't want him to be released so she made up another story.
When he was initially arrested the officer released him. Therefore they did not feel that he was a risk to society. However he is on parole and due to the charges his parole was automatically revoked and he was returned to custody . He has been held since then. He was not eligible for a bail hearing. His parole officer believes that he is innocent and she cannot understand why they did report it in the first place.
He has endured the harsh conditions of jail and his health has suffered as a result of it. He has not been able to support his family. He has lost his job. His children have endured pain and suffering from him not being home. With the outbreak of the Corona Virus he will be held even longer as his case has been put off with the courts primarily only doing video appearances. If I even thought for a second that he did do it I would not still be supporting him. I would not do anything to risk the safety of my children. However I know that it did not happen.
By rewoking an individual's parole the Parole Board of Canada is making an assumption that they're guilty. Even though the Canadian Constitution states that you are presumed innocent until proven guilty. Currently the Board can overrule a judge.
Parole should not be revoked until the individual has gone to Trial and they have been proven guilty. They should be entitled to a bail hearing where their risk is assessed. The Judge or Justice of the Peace can then make the decision to release the individual with or without a surety, with conditions, place them on house arrest or to detain them in custody.
Please sign to show the government that laws need to be changed to ensure that this doesn't happen again to anyone else. Thank you for your support
