PA Felony Murder is inhumane: He didn't Kill Anyone
The Issue
One of the best human beings I've ever met is serving a sentence of death by incarceration. After 32 years there is NO chance despite his maturation, self-development, achievements & NO risk of violence that he will ever be set free.
Robert was 4 months past his 18th birthday when he involved himself in the aftermath of a tragic event his brother ignited on his own. His younger brother shot an innocent man during a car jacking he decided to do on his OWN (there was no conspiracy). Robert has regrets about that entire weekend he came home for a weekend visit from college.
Both Robert & his younger brother were sentenced to LWOP. However, the ruling of Miller vs. Alabama followed by the court's decision on Montgomery vs. Louisiana made Roberts younger brother (16 at the time of the crime) who shot & killed Mr. Yu eligible for parole having served 25 years for 1st degree murder, 2018 he was released from prison after taking a life.
Meanwhile, Robert, who was convicted of 2nd degree (found NOT GUILTY of CONSPIRACY by the jury) is still incarcerated simply because PA law offers no relief for LIFERS.
The state of Pennsylvania had the largest number of juvenile lifers to be re-sentenced. The release of more than 230 juvenile lifers (some of which were the culpable party to cause a death) has shined a huge light on the unjust/unbalanced practices of PA laws and the inhuman process of the PA Board of Pardons (which currently requires a 5-0 vote for clemency applicants to be submitted to the governor for commutation).
This page is dedicated to the hundreds of men/women serving Life sentences that never killed anyone.
However, it is also an effort to campaign and rally support for Robert Allen. Robert is serving his life sentence at SCI DALLAS and filed for clemency in 2020. Sadly, after waiting 2 years for a merit review hearing, Robert was denied the opportunity for a public hearing. Clemency was the only hope of getting Robert out so he may prove that he IS NO DANGER to society.
In Pennsylvania it is illegal for convicted defendants to contact the victim and/or their relatives to express remorse. Therefore, many victims falsely believe people serving time are not remorseful. Nonetheless, the victim's widow in this case had the humanity & compassion to meet with both Robert and his brother through the state's Victim Advocacy program. That opportunity created a time of healing & understanding for all parties to start mending. Therefore, supporters of Robert Allen know (and it has been documented) that there is no expressed vengeance by the victims' family for Robert to stay in prison until death. So, we know LIFE without parole is NOT what all victims want. It is up to the Board of Pardons to step in where the law offers no redemption. Robert has filed for a second time since his initial denial. But Applications now take 4 years before a vote is taken.
Additionally, 4 years ago The Marrone Law Firm filed a motion in Federal courts sadly December 2024 his federal claims were denied.

His brother/co-defendant who stole an innocent’s mans life over a vehicle has been living a “wonderful, rich and blessed life” for nearly 8 years. Robert will die in prison and he did NOT kill anyone nor conspire to steal a car. His suffering has to stop. 🛑
