Overturn Judges order to reinstate house arrest order

The Issue

Our family has been living a nightmare. My son, who has had no violations against him, was placed back under house arrest following an emergency hearing that we were not informed about with Judge Timothy Kreiger at Westmoreland County Courthouse in Greensburg PA. This decision is not only unjust but also undermines the very principles of our legal system.

My son suffers from a serious medical condition which is medication resistant epilepsy and had a traumatic brain injury from a near drowning that resulted in an anoxic brain injury secondary to seizures on his 10th birthday. We still haven’t seen the camera footage from that night so I can’t speak for sure if he was in a partial complex seizure (like sleep walking where you’re unaware of your actions or surroundings ) or if he was postictal which is a complete state of confusion that can last minutes to hours to days. Despite his medical history, he is facing criminal charges including several felonies that arose during one of these medical episodes. Twice, he has been found legally incompetent and unrestorable and his ankle monitor was removed at the probation department's request. 

Yet, under questionable circumstances, a judge reinstated his house arrest after a sudden emergency hearing initiated by a complainant, who happens to be part of the law enforcement community as a detective. This decision was made without our family being given the opportunity to present my son's case or even being notified of the hearing—a right that surely belongs to every citizen. This could be your son, brother or loved one. This could be your grandfather who suffers with Alzheimer’s (another condition that leaves you in a state of confusion). The judicial system cannot be just black or white, there has got to be a gray area  along with education for these medical emergencies. I would also like to point out he was wearing his medical alert epilepsy bracelet at the time.

This situation has turned our lives upside down. A medical crisis should be treated with appropriate medical responses, not punitive measures. The lack of communication and transparency in this process has denied our family the fair hearing that is our son's right.

We demand that this unjust order be overturned. My son deserves the chance to defend himself without being wrongly confined to our home again after serving over a year on the house arrest monitor. We appeal to the authorities to review this case with compassion and fairness, and to act swiftly to correct this error.
