Overturn False Conviction of Judge Tracie Hunter
The Issue
Judge Tracie Hunter was thrust into a fight for justice, not just for herself but for every citizen in the state of Ohio and across the country her lawsuit impacted. Her nightmare documents the abuse of power and miscarriage of justice that elected black women face. In 2010, she was elected the first black and first Democratic Judge of the Hamilton County Juvenile Court in Cincinnati, Ohio. She was not seated judge until 2012 after she prevailed in an election lawsuit against white Republicans that opposed her election. Her opponent, that lost the election, was appointed to the 2-judge Juvenile Court by Ohio's Republican governor before her election lawsuit was resolved. Hamilton County Prosecutor Joe Deters represented her opposition.
In 2013, after witnessing substantial corruption on juvenile court cases by the Prosecutor's Office, Judge Hunter found it her moral and ethical obligation to file an ethics complaint against Prosecutor Deters and several assistant prosecutors. Instead of fostering transparency and justice by the Ohio Supreme Court, her complaint led to acts of retaliation by prosecutors, her opponent Judge John Williams and Republican patronage employees of the Juvenile Court .
Her dedication to truth and justice provoked Deters to have his divorce and criminal lawyers charge her with fabricate crimes. A fixed jury, not of her peers but of those directly tied to the prosecution, convicted her of one. Three jurors came forward and confessed that they did not find her guilty, but were pressured by jury forewoman Sandy Kirkham, a personal friend of special prosecutor Scott Croswell, to sign the verdict. Croswell and Kirkham hid their relationship, that was recently uncovered. Trial judge Norbert Nadel refused to poll the jury, in violation of the law, knowing that the three jurors were going to state their true verdicts were not guilty. He refused to overturn the false conviction after they admitted being bullied.
Even after a forensic computer expert exposed that Judge Hunter's opponents tampered with court computers and changed court records to frame her, they refused to dismiss the fabricated charge because Deters' personal judicial friends presided over her appeals. Deters also maintains close ties with Ohio's Governor.
Because of the power of the Republican Party and Justice Deters, judges have been afraid to overturn the false conviction. She deserves to be exonerated to rectify what Deters and his prosecutorial friends did to frame her; and to bring true justice for her and other innocent citizens who could face a similar injustice if we fail to do nothing.
