My story is unlike most you have read, I am able to clearly show the level of retaliation that my abuser took. On December 28th 2023 (1 year ago) I called the police to report domestic abuse, I went to court to file for custody and I reported my abuse to 2 mandated reporters. 7 DAYS LATER MY ABUSER WENT TO COURT WITHOUT MY KNOWLEDGE AND CLAIMED THAT I ABUSED MY SON AND THE COURTS BELIEVED HIM AND I WAS FORCED FROM MY HOME AND DID NOT SEE MY SON FOR 169 DAYS

I am reaching out to you today as a survivor of domestic abuse who faced shocking and unjust treatment by our legal system. During my court battle, I bravely revealed my husband's abusive behavior, only to see my 6-year-old son handed off to him and be admonished myself. Without a lawyer to help me navigate the complexities, my supporting evidence was disallowed in court for being a day late, leaving me vulnerable to an unethical opposition attorney, and a judge ill-prepared to understand my struggle.
Despite providing crucial evidence such as police reports, photographs, records of doctor visits, and testimonies from school officials, I was denied justice. Even as my husband and his teenage son lied under oath, I was ordered to undergo a mental health examination - a tactic often used by abusers to delegitimize the claims of their victims (National Domestic Violence Hotline).
The situation resulted in traumatizing 169 days of separation from my son, a painful reality that many survivors of domestic abuse face. According to the American Psychological Association, more than half of the cases involving children and abusive fathers result in unsupervised visitation rights or full custody for the abusers.
The court's handling of my case shows a disappointing lack of understanding of the dynamics of domestic abuse. It is critical that we address this issue nationally and demand reform in our court systems to ensure fair treatment and protection for victims.
