Human dignity is inviolable. At least, that’s how it should be. But it isn’t. It isn’t for me and other trans people in Germany. For 40 years now, we are discriminated by the so called “Law for Transsexuals” (TSG). It has been ruled unconstitutional by the federal constitutional court on several occasions (Source: dgti). I am Emma, I am 17 years old and I’m trans. And I’m calling on the n government to change this in 2022!

The Federal Constitutional Court has already declared six provisions of the law to be unconstitutional. Ulrike Lembke, legal scholar at Humboldt University, pointed out in a statement that the reform is constitutionally necessary. She said literally that it was “a shame for the rule of law” that there had been no reform on the part of the federal government, despite repeated sharp criticism from the Constitutional Court (Source: Freitag.de).

Right now, through the TSG, we have to pay thousands of Euros, answer degrading questions and have to “prove” we are actually trans. I find the so-called TSG not only morally reprehensible, but also unnecessary. The law is subject to the logic of "outside determination" and continues pathologization. The fact that trans children and adolescents are dependent on the benevolence and acceptance of their parents is also intolerable (Source: Tagesspiegel.de.

No doctor, no expert, no court, knows better about a person's gender identity than they do themselves. For example, the expert Kalle Hümpfner from the Bundesverband Trans * says: “99 percent of the reports exclusively correspond to the self-assessment of the persons concerned ”(Source: Tagesspiegel). 

Affected parties and associations such as BVT *, LSVD and TrIQ have long been calling for a change or abolition of the TSG, which has been largely declared unconstitutional by the Federal Constitutional Court. A legal opinion from December 2019, which the Federal Ministry for Family, Seniors, Women and Youth (BMFSFJ) commissioned, came to the conclusion that various aspects play a role when changing the gender entry and that the "self-perceived gender identity" is taken into account must be - everything else is against the constitution.
