SIgn The Petition to overturn section Section 154(2)(b) of the Criminal Procedure Act
This law unfairly silences victims of sexual violence.
Rape victims cannot speak the name of the rapist before the accused enters a plea, while victims of other serious crimes face no such restrictions.
Victims of crimes including murder, assault and GBH are all allowed to name the accused before the accused enters a plea.
This is another way that crimes that disproportionately affect women are treated as less serious, fundamentaly undermining the integrity of the accuser in a rape case.
As a result, survivors of sexual violence and their supporters frequently face prosecution themselves when they do name a rapist.
In this day and age, for a law to discriminate against victims of sexual violence is unconstitutional and absurd. Sign our petition to urge the The Minister of Justice and Constitutional Development of South Africa, currently Minister Mmamoloko "Nkhensani" Kubayi, to end the silencing of rape victims by the very laws designed to protect them.
