The Smith family were in a car accident 10 years ago. At the time Layton was 2 years old and suffered a brain injury as a result of the accident. 10 years on and NRMA have not paid the family any CTP greenslip compensation claim, as the technicality of the accident is that "the driver had a heart attack" and therefore there was no negligence or driver at fault. The smiths have lost the liability case and could be subject to pay all legal costs in addition to this unfortunate accident for being in the wrong place at the wrong time. Layton will need ongoing occupational and speech therapy and will not live the normal life the family envisioned for him.
