The Issue

Investment in India by Non-Resident Indians (NRIs) is increasingly becoming riskier with NRIs facing deception due to systemic issues and this petition seeks to bring attention to the urgent and widespread concern regarding the protection of rights for NRI/OCIs across India.

NRIs across the globe have now been compelled to reach out to their embassies to draw attention to the lack of security and protection for their investments and assets in India. This alarming trend not only undermines the confidence of NRIs in investing in India but also tarnishes the reputation of the country as a safe and welcoming destination for foreign investments. NRIs are facing issues ranging from property encroachments to not being handed over their properties by scamming builders to fraudulent bank withdrawals. Life savings have been lost, NRIs are being wrongfully harassed by the system, and are embroiled in costly litigations that seem to be never-ending and there is no clear respite in sight.

In light of these concerning developments, we have come together to advocate for the NRI Protection Bill and urge the Indian government to take immediate action to address the grievances of NRIs by establishing a dedicated agency. This agency would function as an independent investigative agency and court, akin to the CBI or NIA, and would help address NRI grievances digitally with time-bound resolutions. Specifically, we request the following measures to be undertaken:

Establishment of a Dedicated NRI Grievance Redressal Mechanism: Create a specialized authority or department at both the state and national levels tasked with addressing the concerns and grievances of NRIs regarding property disputes across India. This entity should offer timely and effective assistance to NRIs facing legal or administrative hurdles in safeguarding their property rights.

Enactment of NRI Protection Legislation: Advocate for the enactment of comprehensive legislation at both the state and national levels aimed at safeguarding the property rights of NRIs across India. This legislation should provide clear and enforceable mechanisms for resolving property disputes, ensuring fair and equitable treatment for NRIs, and deterring fraudulent practices targeting NRIs.

Enhanced Awareness and Outreach Programs: Launch awareness campaigns and outreach programs at both the state and national levels to educate NRIs about their rights and legal recourse options concerning property ownership in India. This initiative should include informational seminars, online resources, and support services to empower NRIs with the knowledge and tools needed to protect their investments.

Collaboration with Diplomatic Missions: Foster closer collaboration with diplomatic missions and consular offices representing countries with significant NRI populations to facilitate communication and coordination on property-related matters. This partnership can facilitate the timely resolution of disputes and enhance the overall safety and security of NRI investments across India.

In conclusion, the protection of NRI rights is a fundamental aspect of ensuring trust and confidence and ultimately encouraging NRI investment in India which has been significant for India's economy.
