The first trial of Serghei ended in a mistrial because of an 11-1 hung jury in favor of acquittal. Even with this knowledge the prosecution is retrying the second-degree murder and felony resisting arrest charges starting on February 23rd 2018. They failed to prove that Serghei ever saw or "reasonably should have known" Trooper Bava was attempting to pulling him over. Innocent until proven guilty is a vital aspect of our justice system and the first jury showed they will not accept the pure speculation of the prosecution. Jacob Shellabarger is focused on his political ambitions and building his resume. The Trooper and Serghei made the same mistake of speeding too fast on a dangerous highway, and the prosecution is trying to pass the blame of his wreck and death on a young man only guilty of just that: speeding... and wasting taxpayer dollars to do it.
