CEQA Lawsuit Update + Panda Express Fundraiser August 29
PHCPA’s CEQA lawsuit challenging the adequacy of the environmental review for the Marici BESS project in the City of Industry is active, moving forward, and continuing the fight for our community.

Where Things Stand As of August 18, 2026:
- City of Industry Tried to Stop Us: The City of Industry filed a demurrer attempting to knock out our petition early. The court granted us the right to file an updated, amended petition to refine our claims, keeping our lawsuit fully active and on track.
- Next Court Date: A Trial Setting Conference is officially scheduled for November 5, 2026.
- Missing Records: The City of Industry faced a July 27, 2026 deadline to deliver certified administrative records. As of today, those full records have still not been delivered.
