
Four years have passed and the legal proceedings to convict the man responsible for Nadya’s death have been continued, over and over again, as result of Vongunten waiving his right to a speedy trial. Barely any progress was made during this four year period; Vongunten was only recently ordered to appear in court in 2019 and was released on bail shortly after his arrest. Since that time, he had been represented by his lawyer in court. His lawyer tried on three separate occasions to “loophole” his way into receiving probation. All three judges said no. For myself this has been an extremely arduous process that is still, not close to being over. Four years later, inspired by the lack of justice that I’ve felt constantly throughout this battle, I am asking for help once again to petition the Ventura County District Attorney to charge Mr. Vongunten with DUI as well as Gross Vehicular Manslaughter. As of today, the District Attorney’s office is not charging Vongunten with DUI (which is what he was arrested for) and only Gross Vehicular Manslaughter because they do not believe they have sufficient evidence to prove the DUI, and therefore feel such a charge would only undermine the totality of their case. I understand where they are coming from, but I respectfully disagree. Justice for Nadya needs to be done. People don’t just drive motorcycles into the side of moving trains in broad daylight. I do not know what can be done, if anything can be done at all. I do not want to attack our District Attorney’s office but at the same time I at least want to make an impact on them. I can’t help but feel that if my sister was a celebrity or perhaps wealthy, that her death and slaughter would not have been treated the way it was. The CHP arrested Vongunten for DUI and he should be charged with DUI as well as Gross Vehicular Manslaughter. Whether or not he is guilty of those charges should be decided by a jury of his peers or a bench trial.
