We have submitted a pre action protocol for judicial review to Newcastle City Council. Judicial review is a court proceeding, by which a judge reviews the lawfulness of a decision by a public body. The pre action protocol sets out steps to be taken by those wishing to bring a claim to court. These steps aim to ensure all parties are aware of the problem in dispute and what each ‘side’ states to be the case. We have challenged the council on the grounds of misapplication and misinterpretation of local and national policies relating to Green Belt, open space, biodiversity and sustainable development. Newcastle City Council has until 10th April to respond. We understand there are ongoing discussions relating to the S106 legal agreements between Newcastle City Council and Newcastle Great Park Consortium and an extension of time has been requested until 31st May 2018. There was insufficient time to discuss landscaping issues at the meeting on 20th March, and it is understood this will be discussed at the next Castle Ward meeting.
