While the Town of Narragansett condemned the building based on our Building Inspector's Report and ordered Procaccianti Developers to demolish the building as James Procaccianti and Joseph Paolino intentionally neglected its building, the RIDEM is attempting to pass the tax burden for the cleanup on the taxpayers of Rhode Island.   The above photo shows the orders by the Town of Narragansett giving demolition orders to James Procaccianti and Joseph Paolino as they are the owners on record when the building was officially condemned by the Town of Narragansett.    Here is a link to an article from the South County Independent:  Town of Narragansett Orders the Lighthouse Inn to be condemned and demolished.
 

The Following Letter was sent to the Rhode Island Attorney General's Office to have them open an investigation on my behalf.   I was told by the RIDEM they have no one record on who went on record to say the RIDEM will be paying for the demolition of the Lighthouse Inn, or they stated they are not authorized to release such information to me.    

Dear Sir/Madam, 

 I would like the RIAG to open an investigation on my behalf.   I requested information regarding who from the RIDEM noted the RIDEM will be paying for the demolition of the Lighthouse Inn / Dutch Inn located in Galilee, RI.   


 The RIDEM noted the records do not exist regarding who told the Boston Globe reporter the RIDEM will be paying for the demolition of the Lighthouse Inn.   I appealed to the Director's Office, and Legal Counsel, Mary Kay, responded back for Director Gray.   She noted, upon her review the records do not exist and/or she is not authorized to release the information.   Please see the attached documentation.  


  In the following Boston Globe Article, the reporter, Alexa  Gagosz, noted the RIDEM noted they will be paying for the demolition and issuing an RFP for the demolition, yet, the RIDEM contends there is no one on record from the RIDEM who approved the demolition.      Here is a link to the Boston Globe Article:  R.I.’s Lighthouse Inn to be demolished, and the state will foot the bill - The Boston Globe.    Reporter from the Boston Globe noted the RIDEM will be paying for the Demolition of the Lighthouse Inn


  Therefore, I would like the RIAG to open an investigation as the RIDEM has failed to provide me with the requested information they must have on file on who ordered that the RIDEM will be paying for the demolition of the Lighthouse Inn.  


    The following comments have nothing to do with my grounds for the RIDEM to open a case against the RIDEM for failing to provide me with my requested information as part of my APRA Request, but the below evidence is presented for the RIAG Office to open an investigation and to file criminal charges against Procaccianti Developers.  In addition, if warranted, the RIAG may want to file charges against the RIDEM for failing to uphold the law by the RIDEM failing to bring charges against Procaccianti Developers.   


   As the RIAG is well aware, the Lighthouse Inn was intentionally abandoned by Procacianti Developers (James Procaccianti and Joseph Paolino) and the hotel is now a health, safety, and an environmental hazard, where we have live seagulls trapped until their death.

The Town of Narragansett's Building inspector has determined the building is a health, safety, fire, and an environmental hazard.  Please see the attached report, yet the RIDEM wants the State (RIDEM) to pay for the demolition.     The RIDEM is FAILING in its fiduciary responsibility to prosecute those who intentionally harmed the environment.   And to add insult to injury, the RIDEM wants the State of RI to pay for the demolition of the Lighthouse Inn where the need to demolish the building was created by the intentional neglect of James Procaccianti and Joseph Paolino.  


Therefore, the RIAG Office should file criminal charges against Procaccianti Developers for reckless endangerment.   It is beyond belief our Justice System has allowed Procaccianti Developers to even open up litigation against the RIDEM, the Town of Narragansett, and the State Properties Committee.    The litigation proceedings should be thrown out as the litigation is frivolous, and the litigation is a PLOY by James Procaccianti and Joseph Paolino to tie the matter up in Court.    James Procaccianti and Joseph Paolino clearly breached the terms of the lease with the RIDEM and in so doing created harm to the State of RI, its residents, the area businesses, wildlife, and our environment.   If this was an ordinary citizen or a business, the individual or businesses would be summoned into court, charged, fined, and possibly face imprisonment for acting recklessly.   And the RIDEM and the RIAG Office would be leading the prosecution proceedings.   Therefore, I beg and plead that the RIAG Office does the right thing and file criminal charges against James Procaccianti and Joseph Paolino for reckless endangerment.  The RIAG should also motion to the Courts that the litigation proceedings need to be thrown out, and that Procaccianti Developers needs to pay for all legal fees and the demolition of the Lighthouse Inn as noted by the RIDEM lawyer, Mr. Landry.
