Hello I'am the mother to a little girl who's father wrongfully received custody in 2010. Her father and I had a shared parenting agreement, this agreement came after a domestic violence call which turned into my child's father lying to police, when the police came he told them I was "trying to kill myself" (Never would I think of doing such a thing, nor did I say such a thing) at that time I was trying to tell the officers that he had just had me locked in a room with my child after hitting on me. He then told officers that he put his hands on me because of me trying to "kill myself" so he was trying to "help". I was then told that I would have to either voluntarily go down to be psychologically evaluated or they was taking me against my will because I was a harm to myself due to what my child's father told them..

So I volunteered to go, while I was there being evaluated my child's father went to the courthouse and seeked an order for custody. When I was completely cleared and released, I found out about this order. I then went to the Court house to change it. They said it couldn't be changed just like that and made us go with shared parenting, but some how they made him the Custodial parent even tho I stated on record I did not want him to have more rights than me.

Throughout the course of said agreement things was not working out , Her father was not following the order, so I attempted to take him back to court to change it, During that time my daughter wasn't seeing her father much, he would only see her about once a month or so,  but would scream and cry and throw a fit when she did have to go with him, she even did this in front of daycare providers. Things changed after a visit she had with him in November of 2010. She came home and was telling me of things her father was doing to her, in disbelief of the things I was being told from my 4yr old, I reached out to therapist, the therapist confirmed what my daughter was telling me to be true. I was then told by the Therapist that she filed a report to Children Services and Local Law Enforcement, I instantly dropped to the Floor not knowing what else to do I called My Attorney. He went to Columbus and filed against our current order with evidence of the abuse and a statement from the therapist. My child's father was brought in for questioning but was cleared because Her father then stated the abuse couldn't of came from him that it was my 5yrs old child, who I had evaluated and was completely cleared after such allegation from my child's father was made. They stated my 6yr old was incompetent of doing such things. I then requested a Guardian ad litem per my lawyer's order, I was hopeful but the Guardian ad litem claims she was unable to obtain any records regarding the reports from the therapist to Children Services in my county, even though I had gave her copies, she went with whatever my Childs father said instead of having the factual evidence regarding the abuse my child stated to the therapist. This was detrimental because the Guardian had nothing but his word to go with as she claimed. She didn't care about nothing I had to tell her or about the evidence that I had. So My daughter's father still remained Custodial parent of our child.

Her father took off to Arizona before the case was finalized basically to keep her from me. I haven't seen my child in 5 years, he doesn't let me talk to her, I don't know where she attends school, I can't even call her for her birthday, he has completely alienated me from my child's life. I have done nothing but try to protect my child and myself, he has lied to police, the courts countless times, he some how walks free of contempt charges with mounting evidence against him. A therapist who is by law and mandated reporter made a report with concerns of abuse against my child's father and they still allowed him to lie!!! Are we supposed to believe the abuser not the innocent one being abused??? 

The system is flawed in this way, CHANGE NEEDS MADE!!! How can child abusers, whether CPS finds it unsubstantiated or not walk away with custody to a child they have caused harm,  whether it be physical or mental, any form of child abuse is unacceptable. If a child tells their parents, daycare providers and therapist of such things and the One it's said towards just lies and Manipulates the system??? The system has failed my child because of this. HER VOICE has been completely stripped and silenced!!!. I feel under certain circumstances parents should have to undergo a evaluation of some sort. Also, If the state would of looked they would have seen my daughter's father has a history of violence (Civil Protection orders on him) and such offenses should not be favorable or said to be in the Best Interest of ANY CHILD. I feel so helpless to not be able to protect my own child! I'm currently on the search for my beautiful Daughter! I need my baby home!! Justice needs served for my daughter and other children like her that are stripped of their VOICE!! My fight is NOT over until my baby girl is in my arms again and other children have a VOICE!!!
