Indigo should refund the credit shell amount, as it is Breach of Contract with customer

The Issue

Respected Sir,

It is a matter of immediate attention to be brought to your notice that Indigo Airlines are not refunding the money paid to them for booked flights which are cancelled due to COVID - 19. And now the aftermath of COVID-19, Indigo is forcefully keeping the money paid by every customer and flight service not given due to COVID -19 in the form of CREDIT SHELL.

Honourable Supreme Court, A bench of Justices N V Ramana, S K Kaul and B R Gavai, which heard the matter through video-conferencing, issued notices to the Centre and the Directorate General of Civil Aviation (DGCA) on the plea which has urged the court to declare the alleged action of airlines of not refunding the entire value of cancelled air tickets as violative of the civil aviation requirement issued by the authority

Sir, Indigo Airlines being an economy class carrier, people travelling with such airlines are mostly Middle-Class families. It is brought to your kind attention that Indigo has added a new policy of CREDIT SHELL REFUND, over and above the terms and condition agreed by the customer during flight booking. 

In summary, firstly, Customer money is forcefully kept with Indigo for which Indigo was not able to provide services due to COVID - 19 (However, as per terms and condition, airlines should refund the money through the same mode of transaction in case of cancellation by airlines). Secondly, Indigo will earn interest for the money kept in the form of Credit Shell till the time Passenger will not book the ticket with them. Third, if the passenger would not be able to book flight ticket again within one year due to any situation (such as govt employee may not get leave for LTC), the whole amount will be forfeited.

Sir, it's being clearly a breach of contract as per the terms and condition on the date of booking of flights. I hereby request you to kindly instruct the Indigo Airlines to immediately initiate the refund as other carriers ( Spice Jet) has refunded the total amount already.
