Moment Residents Demand Better Living Conditions

The Issue

It is widely understood that functional amenities—such as elevators—are a key part of rental agreements. Living in a luxury apartment building without a complete set of functioning elevators has made daily routines tremendously challenging for all residents, and while 75% of building's elevators are not functioning, we are still expected to bear this burden alone and continue to fulfill our part of the agreement without any concessions.

For months, the elevators have been broken, causing daily hardships for all, particularly for tenants with mobility challenges, elderly residents, pet owners, and families with young children. Additionally, all residents endure extended wait times during high-traffic hours, such as before and after work. Through out the course of the week, residents may end up waiting over an hour combined times just for the elevator. To combat excessive wait time, residents may be forced to ride the elevator with it being clearly over capacity, posing safety concerns over weight restrictions. Not to mention the overuse of a single elevator with 45 floors of residents!

Despite numerous requests for prompt repairs, the situation remains unchanged, and the lack of reliable elevator service continues to negatively impact the quality of life for everyone in the building. At times elevators have been inoperable without any prior notice, residents only finding out when they go to use the elevators. Fair and adequate living conditions should be guaranteed to all tenants, and the failure to maintain essential infrastructure, such as elevators, justifies apologies and concessions from Windsor Communities.

Nationwide, an estimated 30% rent reduction is granted whenever essential services, like functioning elevators, are not provided (Friedman, Randolph. "Housing Law and Policy").

Given this, We, the residents of Moment Luxury Apartments at 545 N McClurg Ct, Chicago, are petitioning for a backdated 50% reduction in rent due to the ongoing and unresolved issues with the elevators in our building until the matter is resolved.

We are asking for a rent reduction as fair compensation for the inconveniences, risks, and difficulties imposed on us due to the building’s failure to provide promised services. This petition aims to ensure that tenants are not over-burdened by circumstances outside our control, and that the landlord (Windsor Communities) takes swift action to resolve this issue. We believe this is a fair and just request that should have been offered to us in sincerity before this petition was made. The landlords must recognize the significant strain their inability to resolve this issue is placing on us, the tenants, and take immediate action to repair tenant-landlord relationships.

If we do not receive a 50% rent reduction until this matter is fully resolved, we will be forced to take further action to protect the interests of current and future tenants. Specifically, we will post detailed and honest negative reviews on Google, Zillow, Yelp, and other review platforms, making potential renters aware of the building’s poor infrastructure, lack of responsiveness from management, and the ongoing challenges we face as tenants.

We hope management will resolve this matter amicably and avoid further escalation. However, if no rent reduction is offered, we will take this necessary step to inform the public and ensure that others are not subjected to the same ongoing difficulties.

We believe transparency is crucial, and we stand united in calling for a fair solution.
