We have just been informed by the Home Office that they are exercising their discretion to terminate proceedings that would move Khushal and his asylum application to Hungary, citing article 17 of the Dublin proceedure:
"(17) Any Member State should be able to derogate from the responsibility criteria, in particular on humanitarian and compassionate grounds, in order to bring together family members, relatives or any other family relations and examine an application for international protection lodged with it or with another Member State, even if such examination is not its responsibility under the binding criteria laid down in this Regulation."
Thankfully this decision does seem to implicitly recognise that the circumstances of Khushal's case merits particular attention from the UK as opposed to other EU countries he has crossed in transit.
I can't be sure, but I do have my doubts as to whether this very reasonable decision would have been taken but for the collective pressure that all of you who wrote to your MPs and emailed the Home Office have exerted. So, even if we have still had no peep from the august Mr Brokenshire, a huge thank you from Khushal for your support!
Next stop will hopefully be his case finally being considered on its own merits by the Home Office.
