
We did it! WE WON! The 3rd District Court of Appeals reversed the Nov 2021 Calusa zoning approval & our Calusa Rookery must be preserved! This judgement removes the Nov 2021 approval for the GL Homes site plan to build 550 homes and reverts the possible development approval to ~32 estate homes.
This is a HUGE win for our Calusa community & wildlife. We are thrilled our advocacy made such a significant difference!
Right now, the County and owners/developer have asked the 3rd DCA to reconsider its ruling and for the Florida Supreme Court to consider the impact of required notice as a question of great public importance. We are confident the 3rd DCA opinion will be upheld, and await the panel's final decision.
Through their monthly surveys, Miami-Dade County DERM staff independently verified imperiled Tricolored Heron nesting at the Calusa Rookery. Six Tricolored Heron chicks were hatched, raised and fledged during the 2022 nesting season at the Calusa Rookery. This means that no matter what future development requests may be for this property, the County will now require that the Calusa Rookery be preserved and protected.
