The Belgian courts and the Belgian minister of animal welfare Ben Weyts have decided on November 3rd 2021 that YOUR DOG IS NO LONGER YOUR DOG WHEN YOU CHIP IT AND WHEN YOU REGISTER IT IN A DATABASE.
As chipping and registering a dog (or cat or horse) is a EUROPEAN matter (EU directive 576/2013), the Belgian legislation also concerns YOU and YOUR DOG.
What applies in Belgium, logically also applies to all other EU countries. Especially as the Belgian minister Ben Weyts has claimed before the Flemish parliament that his decision was taken with the full consent of the European Commission.
Both the Belgian government AND the Belgian courts have decided that from December 1st onwards (date that the oral decision will be published in writing by the criminal court of Ghent), ANYONE who has an animal in his or her possession - even a lost or stolen animal - can register it in his or her name - REGARDLESS OF WHO THE OWNER IS. This is no longer a criminal act, neither is the falsification of the EU passport that comes with it.
The person who registers an animal in his or her name - even if that person is a thief - now legally becomes the new owner of an animal. The Belgian government does so by replacing the notion owner by the notion "responsible person" and claims that the address where a dog resides, defines who the "responsible person" is. You, as the legitimate owner, loose your dog, cat or horse.
If you, as the legitimate owner, want to get your pet back, YOU must go to court and YOU must prove you are the owner of your dog and YOU must pay ten thousands of euros to get your own pet back. All of this because of mandatory chipping and registration ! If you don't have money for a lawyer, you'll never see your pet again.
Basically this joint decision of the Belgian government and the Belgian courts means that anyone can steal any animal - legally - and register it in their name in dogID, catID or horseID and falsify the EU passport.
VETERINARIES NO LONGER HAVE THE OBLIGATION TO CHECK WHO THE OWNER OF AN ANIMAL IS, before registering an animal in a national database. This was decided by the Belgian court of Ghent. We never signed a card or received a letter notifying us that the chip of our Maya would be registered in the name of a thief.
The national databases don't have the obligation either to check who the owner of an animal is, according to Minister Weyts before the parliament. He admitted there are ZERO controls for new registrations. The parliament has confirmed the problems are "enormous" and have been known for YEARS.
This comes down to legalizing animal theft and falsifications of EU animal passports and eradicating ownership of an animal.
UPDATE : similar animal legislation that abolishes property rights is now (May 2022) also in force in Australia - read here.
Basically, there is no point anymore in chipping and registering your animal, as a registration offers no guarantee whatsoever that in case of loss or theft, you will be reunited with your animal.
On the contrary, chipping your animal now protects thieves. Without a chip, your invoice or adoption contract provides proof of ownership and allows you to get your dog back. With a chip, your proof of ownership is totally disregarded, only the name on the chip matters - even if that is the name of a dog thief. You basically pay to finance a database that makes a thief the new owner of YOUR DOG.
But, if that isn't bad enough : this insane legislation and jurisprudence ALSO LEGALIZES ANIMAL ABUSE. Our Maya was locked up and abused for 625 consecutive days. EVERYBODY knew. No one did anything about it.
After 2 criminal convictions of her thieves, Maya was finally returned to us more dead than alive. Maya's thieves didn't get 1 single euro fine and not 1 single day jail time. They had to pay us 1 symbolic euro while Maya is in need of surgery and needs at least 1 year of rehab.

It's important to share this information with pet owners, as most people are totally unaware of how the "system" works - especially as the EU Animal Health Law has entered into effect last year.

It all began with the theft of a Leonberg dog called Maya. This led to an investigation that took 1 year, where about 100 people were interviewed, and that uncovered massive fraud and corruption involving police, government, court, council of veterinaries who all cover up this legalized dog theft AND animal abuse.

Dear animal lovers,
Our Leonberger dog Maya was stolen on June 7th 2020, my little girl (8 yo) became sick from grief and still needs therapy. Maya's thieves first asked 10.000 euro ransom, then 14.000 euro, then +/- 7.500 euro ransom.
Maya's thieves falsely registered our (chipped and already registered) dog in their name in the (mandatory and clearly unsafe) government database dogID on October 7th 2020. All that took was a phone call to their veterinary and 2 minutes to register Maya online.
Maya's thieves were convicted on June 21st 2021 by the Belgian criminal courts to the (non) sentence of 1 month jail (which in practice means no jail at all) and a fine of ... 26 euro. The thieves also had to return our Maya within 24 hours under penalty of 50 euro per day. Read the verdict here. In the UK, sentences go up to 7 years in jail for dog theft.
The thieves refused to give back our Maya. To avoid payment of the penalty, they filed appeal. In the Belgian courts, a dog is seen as a "thing" and the laws are not adapted to living beings like dogs (who get older, may get sick and die). So while the appeal procedure was ongoing, Maya's thieves could keep her and continue to abuse her.
The European Union SAYS that dogs and cats are a member of the family (but fails to deliver a legal framework that guarantees this) and calls upon the member states for severe sanctions in case of falsification of identification documents. Our stolen Maya has been registered in the database dogID and with her thieves mentioned as "owner" in her passport for more than 1,5 year now, despite countless requests to the (in)competent government agencies to apply EU law correctly - and return our dog immediately, as a false identification gives cause to immediate seizure of an animal.
In short, our Maya has been stolen, falsely registered in the national database with the help of a corrupt veterinarian, resulting in a falsified passport, locked up and abused for almost 2 years and all this time, no one has done a thing about it.
I will say that again, no, you didn't misunderstand : STOLEN ANIMALS CAN ALSO BE ABUSED - LEGALLY.
Our Maya has been locked up for almost 2 years (video here), hasn't gone on a single walk, has been diagnosed with "abandonment fear", is being yelled at, is constantly being fed old bread (the thieves own a bakery and give her the leftovers), cries most of the day and gets "out" about 2 minutes twice a day, once in the morning and once in the evening. She's sometimes entitled to 10 (TEN) minutes on Sunday morning. That has been her life with her thieves.
Just try and imagine your life, with your dog stolen for 1 day, and then multiply that feeling by 625 days of worrying - and crying in case of my daughter. That has been our life for 625 days.
The police - who, according to law, should have returned Maya to us immediatly and without even needing any court procedure - didn't do anything : "it's just a dog" and "we'll wait for the courts final decision".
Maya's abuse hasn't been investigated, witnesses have not been heard, animal welfare legislation has not been applied by the police who could have returned Maya to us from day 1.
We therefore tried to rescue her ourselves. We were attacked by her thieves while walking away with Maya in the street. They kicked Maya and tried to strangle her (video here) and repeated they'ld rather kill her than return her alive.
Afterwards, they put an elektroshock collar around her neck and electrocuted her to "teach" her not to run away anymore if we would come back and call her name again. This torture is legal in Belgium. Electrocuting a perfectly educated Leonberger and putting her in continuous pain and stress is not considered animal abuse in Belgium.
The government "animal welfare" service claims that "there is food and water and no visible signs of beatings" so there is no problem - our baby could stay with her thieves until the court procedures were over.
We have contacted every possible entity (police, mayor, governor, minister, media, press, animal welfare, animal protection, lawyers, ...) but nobody cares - "it's just a dog".
We care. And she's not "just a dog". She's our family.
We have now created a website (in Dutch only, sorry) called www.gestolenhond.be (that means stolen dog). It gives information to dog owners whose dog gets stolen and the (few) laws that apply (but are not enforced by the police). Testimonies of other victims of dog theft show that people are continuously informed wrongly by the police. It's important to raise awareness about this horrendous (lack of) legislation.
We would like to ask your help to sign and help share this petition and its updates below with as many animal lovers as possible, and to leave your comments / suggestions to do better in the comments, so there will never have to be another Maya again. Because there are thousands of Maya's and thousands of broken hearts. The petition is adressed to the Belgian minister of "animal welfare" Ben Weyts - who knows about Maya's case since 2020 and hasn't lifted a finger - and the European Commission and the European Parliament.

Bijna anderhalf jaar na haar diefstal wordt leonberger Maya nog steeds gegijzeld door haar dieven - ONDANKS het feit dat de hondendief correctioneel is veroordeeld en ONDANKS het feit dat Maya sinds meer dan een jaar meteen kan worden opgehaald door Dierenwelzijn.
Op 7 oktober 2020 liet Maya's dief immers haar chip overschrijven op zijn naam met de hulp van een malafide dierenarts. Deze frauduleuze registratie is een inbreuk op de dierenwelzijnswetgeving, waardoor Dierenwelzijn perfect kan optreden - LOS van de lopende procedure die enkel betrekking heeft op Maya's diefstal en verduistering.
Een kind werd hierdoor ziek, maar nobody cares. Op 19 maart 2021 werd Maya voor een tweede keer gestolen, dit keer door ... de politie. Waarom Maya's verhaal voor jouw hond relevant is, lees je hier.
Steeds meer mensen delen hun verhaal over hun gestolen dieren. Het loopt systematisch fout. Laat ons daar iets aan doen.

Neen, mijn dier is een volwaardig lid van mijn gezin. Mijn dier is als mijn familie. Mijn dier verdient liefde, goede zorgen en een daadwerkelijke bescherming tegen diefstal, verwaarlozing en iedere andere vorm van dierenleed.
Bring Back Maya
Leonberger Maya werd samen met haar paspoort op 7 juni 2020 gestolen en hierop verduisterd. Maya was correct gechipt en geregistreerd en beschikt over haar aankoopfactuur van een erkende kweker en stamboekpapieren.
Een malafide dierenarts registreerde Maya's chip in dogID op 7 oktober 2020 op naam van de hondendief, zonder akkoord of medeweten van Maya's eigenaar.
De lokale politie weigerde om Maya terug te bezorgen aan haar eigenaar, alhoewel zij over de eigendomsbewijzen beschikt en foute registraties in dogID een inbreuk op de Dierenwelzijnswetgeving zijn, waardoor de politie vanaf dag 1 probleemloos kon optreden.
Maya wordt bijna 1,5 jaar voortdurend opgesloten en verwaarloosd. Door haar isolement ontwikkelde ze verlatingsangst. Ze gaat nooit wandelen, wordt afgeblaft, is moddervet en krijgt elektroshocks toegediend. Sinds de start van de petitie is Maya overgedragen aan de dochter van Maya's dieven.
De Dienst Dierenwelzijn voerde nooit controle uit op het verblijfsadres van Maya en weigerde Maya op te halen alhoewel zij dit vanaf dag 1 probleemloos kon.
DogID en kabinet Weyts weigerden om de frauduleuze registratie te corrigeren. DogID gaf toe geen controles uit te voeren. Minister Weyts bevestigde de afwezigheid van controles bij nieuwe registraties in het Vlaams parlement.
Maya's dief werd op 21 juni 2021 door de correctionele rechtbank veroordeeld tot een (schijn)straf van ... 1 maand cel met uitstel. In Engeland krijgen hondendieven tot 7 jaar cel omdat honden er beschouwd worden als lid van het gezin.
De dierenarts werd ongemoeid gelaten door de Dienst Dierenwelzijn en door de Orde van Dierenartsen. Spijt van haar daden heeft ze niet. De Gentse correctionele rechtbank weigerde om een eerlijk proces te voeren en sprak haar vrij op 3 november 2021.
Door de straffeloosheid van dit gedoogbeleid besloot Maya's dief het bevel van de rechtbank om Maya terug te geven, te negeren.
Hij tekende beroep aan en kondigde al aan ook in cassatie te zullen gaan. Maya zal dood zijn voor deze procedures rond zijn. Maya's dief schreeuwt zijn 'bescherming van hogerhand' van de daken. Minister Weyts wil hondendiefstallen omtoveren tot 'eigendomsdiscussies' en wil deze allemaal voor de Vrederechter brengen.

Er zijn door dit falend beleid duizenden Maya's en gebroken harten in ons land. Laat ons daar samen positieve verandering in brengen.
No More Maya's !
DogID is een onveilige database die door het gebrek aan controle en sancties diefstal legaliseert. Een SAFE code en snelle en gratis rechtzetting van fouten is noodzakelijk. Een onbetrouwbare database kan je niet verplichten.
Controles op dierenartsen zijn onbestaande. Wij vragen strenge sancties voor malafide dierenartsen die in een publiek toegankelijk register worden gepubliceerd. Zo kunnen eigenaars zelf de betrouwbaarheid van een dierenarts controleren en zo creëer je een ontradend effect.
Dierendiefstal, verduistering, verwaarlozing en mishandeling van dieren wordt nauwelijks of niet onderzocht of bestraft. Wij vragen strenge straffen voor wie honden steelt en dierenleed veroorzaakt. Bij een minimumstraf van 5 jaar cel zullen boeven 2 keer nadenken voor ze een dier stelen, verduisteren, verwaarlozen of mishandelen. Zo voorkom je op effectieve wijze hondendiefstal en dierenleed.
De lokale politie bezondigt zich aan vriendjespolitiek en schiet schromelijk tekort in haar opdracht inzake dierenwelzijn. Wij vragen duidelijke instructies voor en zo nodig schorsing van agenten die de dierenwelzijnswetgeving weigeren toe te passen, weigeren om vaststellingen te doen of PV op te stellen. Door deze lakse houding moedigt de politie zelf diefstal, verduistering en verwaarlozing van dieren aan. Een autodief laat je niet lopen, een hondendief wel ?
De Dienst Dierenwelzijn faalt schromelijk en plaatst politieke en financiële belangen boven het dierenwelzijn. Wij vragen dat de inspecties en inbeslagnames terug uitgevoerd worden door onafhankelijke, lokale dierenbeschermingsorganisaties. Dit is de enige manier om belangenvermenging uit te sluiten en snel en kordaat te kunnen handelen.

Maya wordt bijna 1,5 jaar voortdurend opgesloten en verwaarloosd. Door haar isolement ontwikkelde ze verlatingsangst. Ze gaat nooit wandelen, wordt afgeblaft, is moddervet en krijgt elektroshocks toegediend. Sinds de start van de petitie is Maya overgedragen aan de dochter van Maya's dieven.
De Dienst Dierenwelzijn voerde nooit controle uit op het verblijfsadres van Maya en weigerde Maya op te halen alhoewel zij dit vanaf dag 1 probleemloos kon.
DogID en kabinet Weyts weigerden om de frauduleuze registratie te corrigeren. DogID gaf toe geen controles uit te voeren. Minister Weyts bevestigde de afwezigheid van controles bij nieuwe registraties in het Vlaams parlement.
Maya's dief werd op 21 juni 2021 door de correctionele rechtbank veroordeeld tot een (schijn)straf van ... 1 maand cel met uitstel. In Engeland krijgen hondendieven tot 7 jaar cel omdat honden er beschouwd worden als lid van het gezin.
De dierenarts werd ongemoeid gelaten door de Dienst Dierenwelzijn en door de Orde van Dierenartsen. Spijt van haar daden heeft ze niet. De Gentse correctionele rechtbank weigerde om een eerlijk proces te voeren en sprak haar vrij op 3 november 2021.
Door de straffeloosheid van dit gedoogbeleid besloot Maya's dief het bevel van de rechtbank om Maya terug te geven, te negeren.
Hij tekende beroep aan en kondigde al aan ook in cassatie te zullen gaan. Maya zal dood zijn voor deze procedures rond zijn. Maya's dief schreeuwt zijn 'bescherming van hogerhand' van de daken. Minister Weyts wil hondendiefstallen omtoveren tot 'eigendomsdiscussies' en wil deze allemaal voor de Vrederechter brengen.

Er zijn door dit falend beleid duizenden Maya's en gebroken harten in ons land. Laat ons daar samen positieve verandering in brengen.

DogID is een onveilige database die door het gebrek aan controle en sancties diefstal legaliseert. Een SAFE code en snelle en gratis rechtzetting van fouten is noodzakelijk. Een onbetrouwbare database kan je niet verplichten.
Controles op dierenartsen zijn onbestaande. Wij vragen strenge sancties voor malafide dierenartsen die in een publiek toegankelijk register worden gepubliceerd. Zo kunnen eigenaars zelf de betrouwbaarheid van een dierenarts controleren en zo creëer je een ontradend effect.
Dierendiefstal, verduistering, verwaarlozing en mishandeling van dieren wordt nauwelijks of niet onderzocht of bestraft. Wij vragen strenge straffen voor wie honden steelt en dierenleed veroorzaakt. Bij een minimumstraf van 5 jaar cel zullen boeven 2 keer nadenken voor ze een dier stelen, verduisteren, verwaarlozen of mishandelen. Zo voorkom je op effectieve wijze hondendiefstal en dierenleed.
De lokale politie bezondigt zich aan vriendjespolitiek en schiet schromelijk tekort in haar opdracht inzake dierenwelzijn. Wij vragen duidelijke instructies voor en zo nodig schorsing van agenten die de dierenwelzijnswetgeving weigeren toe te passen, weigeren om vaststellingen te doen of PV op te stellen. Door deze lakse houding moedigt de politie zelf diefstal, verduistering en verwaarlozing van dieren aan. Een autodief laat je niet lopen, een hondendief wel ?
De Dienst Dierenwelzijn faalt schromelijk en plaatst politieke en financiële belangen boven het dierenwelzijn. Wij vragen dat de inspecties en inbeslagnames terug uitgevoerd worden door onafhankelijke, lokale dierenbeschermingsorganisaties. Dit is de enige manier om belangenvermenging uit te sluiten en snel en kordaat te kunnen handelen.
