The inequality of Justice for Disabilities....They found "no significant failings by the NDIS in the death of Ann Marie Smith" that is so bad as to be laughable, the fact she died on NDIS care was a significant failing by the whole system....Someone in there should be punished at NDIS if not the whole organization...
I found it interesting that the Victorian police would arrest a 28 year old pregnant, no way, young mother in front of her children wearing pjs for trying to organize a protest and posting on Facebook, what a crime...!
Yet when my son was assaulted in a disability respite house the young woman worker who was meant to be looking after him and denying that he was injured and then changing her story a few days later was not questioned by the police even though I kept insisting they should question the worker that was with James she got away with her actions. There were no handcuffs put on her. There should have been.
Oh no said one inspector shes just a young girl (she was 29 years old)
Oh no said another one she will just lie theres not point in questioning her...
A big burley policeman questioning a young girl no it just would not...no he said...
They question p platers of 18 years old plus for speeding why couldnt they question the worker who was with my son? and I believe was the one who hurt him as she denied, lied and covered up there was an injury which all could see and would commment on. That injury lasted another six months of swelling and now still has a mark there on his forehead.
I realized my son did not matter to the police but the worker for some reason did. They protected her but not my son. That is inequality of justice. Because James had a disability they wiped the investigation.
Oh but when a young harmless mother steps up and wants to protest against their precious lock down they put handcuffs on her, she even said she wasnt sure they were police because they had no uniforms on, she thought they were actually kidnapping her and she was frightened. They were making an example of an innocent young woman and going with the Premiers power trip of stopping anyone apposing his plans for Victoria.
How dare they do that to someone making a simple statement on face book!
They never arrested the security guards for leaking the virus out the Melbourne and the rest of Victoria they didnt hand cuff them or the premier for his gross neglect of keeping his people safe, or the age care minister for failing to put prevention and safety in for the old people.
They didnt even put handcuffs on the Rosa Maione disability worker now charged with manslaughter of Ann Marie smith...what I saw from the footage taken she was arrested - no handcuffs - and she neglected Ann Marie to the point of death by not feeding her - it should be murder many parents of disability children see this and are afraid.
the recent recommendations by the investigation into Ann Marie's case stated that there was no "face to face" checking on Ann Marie and it was easy for her to be neglected because no one ever actually checked her!
In other words everyone relied on the evil little carer who let her starve and die to say how Ann Marie was and they left it to the organization Integrity Care not banned to take care of her. No wonder she died.
One corrupt worker and a money hungry organization exploited a woman who was helpless and could not help herself
they saw her weakness and her money left by and exploited it for shame they should all go to prison.
From now on it is recommended that no vulnerable ndis participant should have a sole carer providing services in the participants own home...
Judge Robertson also noted that although care plans by the NDIA are meant to be 'person centred' (ABC news 4th September 2020) they were in fact more characterized as 'transactional'. (about the money not the person).
He noted that neither of the NDIA delegates who approved Ms Smiths statement of participants supports under the Act in the first plan or second plan had a face-to-face or any meeting with her...
By relying only on technology and business people are not cared for properly they become numbers and accounts not people...
Disability people cannot be treated like this - they are firstly isolated because of their disability especially those like my son who cannot speak and those like Ann Marie who could not move herself to escape the prison like situation the carer had put her in. Proper care needs to be taken for those with disabilities especially vulnerable if cannot speak up for themselves.
I cannot believe that the investigation by the Judge found "no significant failings by the NDIS" the whole system is failing our children who are vulnerable - their failing was allowing a woman to be neglected to the point of death. There were failings completely and the NDIS should take some kind of punitive measures for it. Especially Stuart Robert who seems far removed from those he is meant to be looking after!
People must reach out to each other beyond the technology that isolates...it is criminal to not do the right thing and bad workers get away with such crimes as Rosa Maione did for a long time...even possibly stealing the rest of Ann Marie's inheritance...
It takes a community to raise a child how much more a disability child - for the the rest of their life...?
if it is only about economy and not community many will continue to be lost like Ann Marie Smith.?..we must not let that happen...
There must be a safety net in disabilities to catch and protect those from corrupt organizations and providers and even from the NDIS which has proven money driven right from the word go and forgotten it was for human care not exploitation that so many providers have capitalized on.
