
The UK authorities are now far too focussed on crime statistics and performance. Hitting those targets often results in the wrong people being convicted. Together we can change this by demanding full disclosure of evidence when a verdict has been delivered in criminal proceedings. Only then can defendants verify that the authorities correctly applied the disclosure test to the evidence in their possession.
The present situation is of course the reason we have so many miscarriages of justice - at present only prosecutors have the ability to verify that they have made compliant disclosure. Since prosecutors are incentivised to secure convictions, there is no incentive for them to do so. More importantly, no one has better knowledge of what constitutes relevant evidence to their defence than defendants themselves.
It is not the Act itself, which only restricts disclosure until a verdict has been delivered in criminal proceedings, that is at fault. Fault lies with the authorities, who then consider there is no longer any need for the defence to be given full disclosure, and rigorously resist further disclosure.
This is why we believe full disclosure post verdict should be mandatory. How else are those wrongly convicted to mount an effective appeal against their conviction. This is the only way we can get back to having a criminal justice system that is fit for purpose in the UK. Remember, convicting the innocent simply leaves the guilty at large to commit further crimes.
