Liberté et justice pour Christian Kwongang, président sortant de l’Association des Etudiants et Stagiaires Africains en Tunisie (AESAT)

Stop à l’escalade répressive contre les personnes migrantes et contre les libertés publiques en Tunisie

Christian Kwongang, président sortant de l’Association des Etudiants et Stagiaires Africains en Tunisie (AESAT), est officiellement disparu depuis mardi 19 mars 2024. Les autorités tunisiennes doivent le libérer immédiatement et halter toute procédure de déportation sommaire. 

L’étudiant et militant camerounais, inscrit à la Faculté Privée des Sciences de Gestion et de la Technologie (UPES) de Mégrine, résidait et étudiait en Tunisie depuis 2016. En tant que président de l’AESAT de 2021 à 2023, Christian était actif publiquement et intervenait régulièrement auprès des médias et des autorités tunisiennes pour la défense des droits des étudiant.e.s étranger.e.s et des personnes migrantes.

Rien ne justifie la privation de liberté d’un individu au seul motif que son statut serait irrégulier ou que les autorités voudraient l’expulser, et ce d’autant plus que Christian bénéficiait d’un titre de séjour temporaire. L’arrestation arbitraire d’un activiste, ancien responsable associatif, figure de la société civile étudiante, et sa détention au secret, en dehors de tout cadre juridique, constitue une escalade alarmante et manifeste des autorités tunisiennes.

Dans un contexte de rétrécissement de l’espace civique en Tunisie, d’attaques contre les libertés publiques, et de normalisation des abus et violations à l’encontre des personnes migrantes et réfugiées noires (arrestations et détentions arbitraires, mauvais traitements, expulsions collectives illégales aux frontières), l’arrestation et la disparition du président sortant de l’AESAT suggère une volonté des autorités tunisiennes d’intimider tout.e.s ceux et celles qui prennent encore la parole publiquement pour défendre les droits des personnes migrantes, notamment les ressortissant.e.s étranger.e.s membre de la société civile.

Le 19 mars, Christian s’est rendu à un poste de police de Tunis pour récupérer sa carte de séjour, muni de son récépissé, qui équivaut à un titre de séjour provisoire. Malgré que le statut de Christian soit en règle, les agents de police décident de le retenir, sans motif clair, et l’interrogent sur son activité associative au sein de l’AESAT et ses prises de positions publiques sur la situation des migrant.e.s en Tunisie. Il est transféré à la direction générale de la police des frontières et des étrangers, où on lui fait comprendre qu’il doit acheter un billet d’avion pour le Cameroun, en dehors de toute légalité.  

Christian est officiellement disparu depuis plus d’une semaine, ses amis et sa famille n’ayant pas d’informations officielles sur sa localisation. La police ainsi que la direction générale de la police des frontières et des étrangers nient avoir jamais reçu ou détenu l’étudiant et militant.

Des sources informelles suggèrent que Christian serait détenu au “centre d’accueil et d’orientation” d’El Ouardia, au sud du Tunis. Dans ce centre, les autorités tunisiennes détiennent illégalement des ressortissants étrangers avant leur déportation, pour une durée indéterminée, sans aucun fondement juridique. En juillet 2020, le Tribunal administratif avait déclaré la détention de 22 personnes dans ce centre illégale. Par ailleurs, en février et en mars 2024, les autorités tunisiennes ont sommairement expulsé plusieurs ressortissants subsahariens détenus dans ce centre à la frontière algérienne, en dehors de toute légalité.

Stop the repressive escalation against migrants and against public freedoms in Tunisia

Christian Kwongang, outgoing president of the Association of African Students and Interns in Tunisia (AESAT), has been officially disappeared since Tuesday 19 March 2024. Tunisian authorities must release him immediately and halt any ongoing summary deportation. 

The Cameroonian student and activist, enrolled at the Private Faculty of Management Sciences and Technology (UPES) of Mégrine, has been living and studying in Tunisia since 2016. As president of AESAT between 2021 and 2023, Christian was active publicly and regularly spoke to the media and to the Tunisian authorities to defend the rights of foreign students and migrants.

Nothing can justify the deprivation of liberty of an individual solely because of their alleged irregular status or because the authorities want to deport them, even more so since Christian had a temporary residency permit. The arbitrary arrest of an activist, former leader of an organisation, figure of student civil society, and his incommunicado detention, outside of any legal framework, constitutes an alarming and obvious escalation by the Tunisian authorities. 

In a context of shrinking civic space, attacks on public freedoms, and normalisation of abuses and violations against black migrants and refugees (arbitrary arrests and detentions, ill-treatment, illegal collective deportations at the borders) in Tunisia, the arrest and disappearance of the outgoing president of AESAT suggests a willingness from the Tunisian authorities to intimidate all those who continue to speak publicly to defend the rights of migrants, particularly foreign citizens who are members of civil society.

On 19 March, Christian went to a Tunis police station to collect his residency permit, while he had with him a receipt establishing his temporary residency permit. Despite his regular status, police officers detained him without a clear motive, and questioned him about his activity within AESAT and his public positions on the situation of migrants in Tunisia. He was then transferred to the general directorate of the foreigners and borders police, where he was asked to buy a plane ticket to Cameroon, outside of any judicial process.

Christian has been disappeared for over a week, with his friends and family having no official information on his whereabouts. The police as well as the general directorate both deny having ever received or detained the student and activist.

Informal sources suggest that Christian is being held at the “reception and orientation centre” of El Ouardia, south of Tunis. In this centre, the Tunisian authorities illegally detain foreign nationals before their deportation, for an indefinite period, without any legal basis. In July 2020, the Administrative Court declared the detention of 22 people in this centre to be illegal. Furthermore, in February and March 2024, the Tunisian authorities summarily deported several sub-Saharan nationals detained in this centre to the Algerian border, without any legality.

أوقفوا التصعيد القمعي ضد المهاجرين وضد الحريات العامة في تونس

لقد اختفى رسميا كريستيان كوونغانغ، الرئيس السابق لجمعية الطُّلاب والمتدربين الأفارقة في تونس،  منذ 19 مارس. ويجب على السلطات التونسية إطلاق سراحه فوراً ووقف أي ترحيل بإجراءات موجزة.

الطالب والناشط الكاميروني، المسجل في الكلية الخاصة للعلوم الإدارية والتكنولوجيا بمقرين، يعيش ويدرس في تونس منذ عام 2016. بصفته كرئيس لجمعية الطلاب والمتدربين الأفارقة في تونس بين عامي 2021 و2023، كان كريستيان ناشطًا مدنيًا ويتحدث بانتظام في وسائل الإعلام ومع السلطات التونسية للدفاع عن حقوق الطلاب والمهاجرين الأجانب.

لا شيء يمكن أن يبرر حرمان أي فرد من حريته لمجرد أن وضعه غير النظامي المزعوم أو لأن السلطات تريد ترحيله، خاصة وأن كريستيان كان لديه تصريح إقامة مؤقت. إن الاعتقال التعسفي والاحتجاز بمعزل عن العالم الخارجي لناشط مدني، ورئيس سابق لمنظمة، وشخصية في المجتمع المدني الطلابي، خارج أي إطار قانوني، تصعيد واضح ومثير للقلق من قبل السلطات التونسية.

في سياق تقليص الفضاء المدني، والاعتداءات على الحريات العامة، وتطبيع التجاوزات والانتهاكات ضد المهاجرين واللاجئين السود في تونس (الاعتقال والاحتجاز التعسفي وسوء المعاملة والترحيل الجماعي غير القانوني على الحدود)، يوحي اعتقال واختفاء الرئيس السابق لجمعية الطُّلاب والمتدربين الأفارقة في تونس إلى رغبة السلطات التونسية في تخويف كل من ما زالوا يرفعون أصواتهم للدفاع عن حقوق المهاجرين، بخصاصة المواطنين الأجانب أعضاء في المجتمع المدني.

في 19 مارس، ذهب كريستيان إلى مركز شرطة في تونس العاصمة ليأخذ تصريح إقامته، وكان معه إيصال الإيداع يثبت تصريح إقامته المؤقتة. ورغم وضعه النظامي، اعتقله ضباط الشرطة دون دافع واضح، واستجوبوه حول نشاطه في الجمعية وتدخلاته العامة حول وضع المهاجرين في تونس. ثم نُقل إلى الإدارة العامة لشرطة الحدود والأجانب، حيث طُلب منه شراء تذكرة طائرة إلى الكاميرون، خارج أي إجراءات قضائية.

اختفى كريستيان منذ أكثر من أسبوع، ولم يكن لدى أصدقائه وعائلته أي معلومات رسمية عن مكان وجوده. وتنفي الشرطة والإدارة العامة استقبال أو احتجاز الطالب والناشط. 

وتشير مصادر غير رسمية إلى أن كريستيان محتجز في "مركز الاستقبال والتوجيه" بالوردية جنوب تونس العاصمة. وفي هذا المركز، تحتجز السلطات التونسية بشكل غير قانوني مواطنين أجانب قبل ترحيلهم، لفترة غير محددة، دون أي أساس قانوني. وفي يوليو 2020، اعتبرت المحكمة الإدارية احتجاز 22 شخصًا في هذا المركز غير قانوني. وإضافة إلى ذلك، في فبراير ومارس 2024، رحلت السلطات التونسية بإجراءات موجزة العديد من مواطني جنوب الصحراء المحتجزين في هذا المركز إلى الحدود الجزائرية، خارج أي إجراء قانوني.
