I am one among many Indian men who feel deeply impacted by existing marital laws in India. The absence of legal recognition for prenuptial agreements can in some cases, lead to unfortunate and unfair circumstances in conflicts arising from divorce. A lack of such provisions has often left us feeling disadvantaged, fostering a sense of hypocrisy in the law.

Prenuptial agreements, a standard practice in many countries, allow marrying parties to protect their individual rights and assets. According to a report by UN Women, about 46 countries recognize prenuptial agreements, providing clear divorce terms that ensure fairness (UN Women, 2019). The legalization of prenuptial agreements in India would not only afford protection of individual rights but also enrich the democratic ethos of our country.

Let's advocate for a change that ensures fairness and justice. Legalizing prenuptial agreements will not eradicate all issues related to divorce and separation, but it is a significant step towards ensuring that all parties have equal legal protection.
