The Issue
Dear President Tate and LSU Board of Supervisors,
We, the undersigned students of LSU Law, submit this petition regarding the current disciplinary actions being taken against Professor Ken Levy, who has been removed from teaching for expressing political opinions during lectures. We are of the understanding that LSU has instituted disciplinary actions against Professor Levy because of political comments he made on campus. Because we believe that such comments are protected by both the United States Constitution and by Louisiana state law, we demand:
- Full transparency regarding all disciplinary actions being taken against Professor Levy,
- Professor Levy’s immediate reinstatement, and
- A public apology by LSU to Professor Levy.
Free speech and First Amendment protected expressive activities at public postsecondary education institutions by students, administrators, faculty members, staff members, and invited guests are protected pursuant to the First Amendment of the Constitution of the United States of America and Article I, Section 7 of the Constitution of Louisiana. La. Stat. Ann. § 17:3399.32(A). Any person who wishes to engage in noncommercial free speech and First Amendment protected expressive activity on the campus of a public postsecondary education institution shall be permitted to do so freely, as long as the person's conduct is not unlawful and does not materially and substantially disrupt the functioning of the institution. La. Stat. Ann. § 17:3399.32(B).
As LSU has demonstrated a blatant disregard for the protections of free speech with the treatment of Professor Levy, we the undersigned students of LSU Law, are putting LSU on notice that the students are organized and ready to aid in the protection of our fundamental right to free speech. Should LSU fail to meet our demands, we are prepared to take further collective student actions until our demands are met.
