Nous avons été touchés par l'attaque terroriste du Hamas le 7 octobre 2023 en Israël.

Le Hamas, une organisation basée à Gaza, a été impliqué dans de nombreux actes de violence et d'agressions antisémites. Selon le Centre Simon Wiesenthal, une organisation internationale dédiée à la recherche sur l'Holocauste et les droits de l'homme, le Hamas est responsable d'une grande partie des attaques terroristes en Israël depuis sa création en 1987.

Le droit international doit reconnaître ces actes pour ce qu'ils sont : du terrorisme. En reconnaissant officiellement le Hamas comme un groupe terroriste, nous pouvons commencer à prendre des mesures pour mettre fin aux violences perpétuées par cette organisation.

L’usage du terme “terroriste” fait particulièrement polémique. Des groupes politiques, des associations, refusent de qualifier l'attaque du 13 octobre par le Hamas d'attaque terroriste se réfugiant et invoquant cette absence dans le droit international. La conséquence est qu'ils favorisent la montée de l'antisémitisme et légitiment d'une certaines manières les actions du Hamas. 

C'est le cas d'Amnesty international qui refuse de qualifier les actes du Hamas de «terroristes». C'est ​aussi le cas de Jean-Luc Mélenchon qui selon lui reconnaître que le Hamas comme une organisation terroriste empêcherait de les traduire devant la justice pour crimes de guerre.

Au niveau international, il y a des conventions qui régulent le terrorisme, mais pas de textes ni de définitions communément acceptées. L'UE et d'autres pays occidentaux, quant à eux, considèrent le Hamas comme une organisation terroriste. 

Nous pensons que ce qui poserait éventuellement problème dans une définition internationale, c'est que des mouvements de libération voir des mouvements de résistance nationale se verraient qualifier alors de mouvements terroristes par des États peu scrupuleux.

C'est pourquoi une véritable réflexion et coopération doivent être faite rapidement afin de définir les contours de cette nouvelle règle de droit dans le cadre international que nous demandons.

L'Europe s'est engagée à promouvoir les principes de l'ONU puisque l'organisation demeure une institution centrale pour un multilatéralisme efficace mais l'ONU doit permettre au vieux continent européen de pouvoir lutter pleinement contre le terrorisme. Il est donc venu le temps pour l'ONU de considérer pleinement cette demande de modification du droit international sur le terrorisme. 

Il est temps que nous prenions position contre le terrorisme sous toutes ses formes.

The UN must recognize Hamas as a terrorist group.

Hamas, a Gaza-based organization, has been involved in numerous acts of anti-Semitic violence and attacks. According to the Simon Wiesenthal Center, an international organization dedicated to research on the Holocaust and human rights, Hamas has been responsible for a large portion of terrorist attacks in Israel since its creation in 1987.

International law must recognize these acts for what they are: terrorism. By officially recognizing Hamas as a terrorist group, we can begin to take steps to end the violence perpetuated by this organization.

The use of the term “terrorist” is particularly controversial. Political groups and associations refuse to qualify the October 13 attack by Hamas as a terrorist attack taking refuge and invoking this absence in international law. The consequence is that they encourage the rise of anti-Semitism and in certain ways legitimize the actions of Hamas.

This is the case of Amnesty International, which refuses to qualify Hamas's actions as “terrorist”. This is also the case of Jean-Luc Mélenchon who, according to him, recognizes that Hamas as a terrorist organization would prevent them from being brought to justice for war crimes.

At the international level, there are conventions that regulate terrorism, but no commonly accepted texts or definitions. The EU and other Western countries, meanwhile, consider Hamas a terrorist organization.

We think that what would potentially pose a problem in an international definition is that liberation movements or even national resistance movements would then be qualified as terrorist movements by unscrupulous States.

This is why real reflection and cooperation must be done quickly in order to define the contours of this new rule of law within the international framework that we are asking for.

Europe is committed to promoting the principles of the UN since the organization remains a central institution for effective multilateralism, but the UN must enable the old European continent to be able to fully fight against terrorism. It is therefore time for the UN to fully consider this request for modification of international law on terrorism.

It is time that we take a stand against terrorism in all its forms.
