We The People of Kentucky Oppose Red Flag Laws
The Issue
Do you believe in the United States Constitution? The Bill of Rights? If so, you must agree that Red Flag Laws violate these inalienable rights that our forefathers had the wisdom to provide for. Specifically:
1. The Second Amendment gives all Americans the right to keep and bear arms. We already have laws on the books to ensure that individuals convicted of felony crimes cannot own weapons. Red Flag Laws would remove the right from some individuals with only a court's decision that they are “at risk”, without defining what exactly that means.
2. The Fourth Amendment states that no one shall be “deprived of life, liberty or property without due process of law." Seizing the property of individuals who have been convicted of no crime violates this provision.
Under Red Flag Laws, ANY person who believes you are “at risk” can report you to law enforcement and a warrant can be issued to seize your firearms without any proof at all that you are indeed “at risk” for violence. The potential for revenge reporting is great, and such reports would further burden our already burdened courts.
Gun Control advocates would have you believe Red Flag Laws help stop violence but that has not been shown in states with such laws. For example, in Virginia, to stop all firearm related suicides, 12,000 confiscation episodes would be needed per year. Red flag laws enacted in CT nearly twenty years ago haven't been shown to stop a single homicide, and more than twenty people killed themselves after they were disarmed.
Our Founding Fathers designed a system of government consisting of a series of checks and balances in the service of defending liberty. They knew that tyranny was an omnipresent threat, and that tyranny begins with the disarmament of the people. Tell your lawmakers to fulfill their oath to uphold our Constitution by signing the petition.
