Due to the covid-19 pandemic and the movement control order (MCO) we has been extremely impacted and we are no exception. As the result of the crisis, the worker now facing a few problem to be tackle.
- Most Employee are directed TO TAKE unpaid leave
- Employees salaries and allowances ARE NOT paid in full
- Some employees required TO OFFSET their entitle leave
- The worst scenario there are employees has been terminate and not following the retrenchment procedures.
Based on this issue, we expect the solution has to be taken care by the company. On 16th March, in the Media Statement of Malaysian Prime Minister promise they will be no retrenchment, non of the above restricts the employer whose business is subject to a surplus of labour to terminate employees by following the retrenchment procedure.
Employer must continue to pay the full salaries of all employees including allowances during the March 18 until 31 MCO period, said the Minister Of Human Resources. Under The Prevention And Control of Infectious Disease Act 1988, Employer are not allowed to force worker to use their annual leave or unpaid leave during this period.
