Refer Bill C-36 to the Ontario Court of Appeal

The Issue

We believe that Bill C-36 violates sex workers' constitutional rights, and will result in more harm and deaths.

Criminalizing the purchasing and advertising of sexual services will drive sex work into dangerous locations, and will prevent sex workers from screening clients. Making it an offence to receive material benefit from sex work will prevent sex workers from hiring body guards or other supports, and even their friends or family could be criminalized.

Kathleen Wynne is in the position to refer Bill C-36 to the Ontario Court of Appeal. If the Ontario Court of Appeal decides to allow it, it can then be brought to the Supreme Court of Canada.
