The Issue

Canada enacted the Canada Pension Plan (CPP) in 1966.

CPP has always had a Disability (CPPD) function which is exactly like regular Long Term Disability in many respects.

Canada has a public policy to ensure long term financial security.

Canada has a public policy to ameliorate the plight of the disabled.

To protect the long term financial security of Crown benefits, Canada enacted several laws of general application:

1. A general prohibition against interception in Financial Administration Act s. 67, as CPPD is a Crown debt owed to the contributor.

2. A specific prohibition against interception in CPP Act s. 65(1).

However, after the insurance industry pressured government in the 80's & 90's, the CPP Act was amended in 1993 to add a specific exception for a direct payment to the Administrator.

I submit this is an illegal law:

1. It offends public policy.

2. It offends the CPP's SPIRIT & INTENT.

3. It violates FAA s. 67.

It also subsidizes Long Term Disability insurer's at our expense.

The CPP is designed to help PEOPLE!

Please sign this petition & share widely. Subsidizing companies at the expense of the disabled is just MONSTROUS!

However, just to be clear, CPP Act s. 65(3) appears to be misinterpreted.

It allows a SINGLE direct payment if three strict conditions are met under CPP Regulations s. 76(1):

1. Irrevocable consent must be signed: implies you can say NO; &

2. More than $50 must be owed; &

3. The forms must be received no later than 1 year before the payment is made.

Insurers' are extending their right to take FUTURE payments from CPP Act s. 65(3).

I beg to differ.

Parliament would have stated this expressly. That is how laws work.

After the single payment, CPP Act s. 65(1) MUST apply again as there are no more exceptions stated under the law!

Canada, protect the public interest in our long term financial security.

After all, CPP is NOT social welfare but TRUST funds.
