“! No creo que pueda salir de aquí con vida!” fueron las últimas palabras que dijo Shannel a su Tía Laura en la única visita que recibió el 25 de mayo del 2022. Ocho días después, 2 de Junio del 2022, con tan solo 23 años de edad, nuestra amada Shannel sufrió una muerte violenta por medio de un alegado “suicidio”, en la Cárcel de Mujeres de Bayamón en Puerto Rico. 

No hay palabras que puedan describir el dolor, coraje y todos los daños que ha sufrido nuestra familia con la pérdida de Shannel, quien era paciente de salud mental y también dejó huérfana a una niña de cuatro años. 

La secretaria del Departamento de Corrección y Rehabilitación, Ana Escobar, ha dado muchas versiones de lo sucedido. Todo ha sido muy incongruente, frustrante y poco transparente. Desde el arresto hasta hoy, las autoridades involucradas solo nos han dejado más preguntas que respuestas y ninguna investigación ha producido un informe concreto y transparente que nos explique la verdad que nos pertenece.

Por último, el gobernador Pedro Pierluisi nunca ha contestado nuestro pedido para que se conforme  un comité independiente que investigue lo que verdaderamente sucedió a cerca de su muerte, que sigue en disputa. Organizaciones en Comité PARE enviaron una carta al Gobernador y a Ana Escobar el 10 de junio de 2022 en donde solicitaron que la familia pueda tener acceso a toda la información sobre las circunstancias en que murió Shannel y que se asigne un comité externo para que investigue minuciosamente. No ha respondido hasta la fecha. 

• Independientemente de su condición de salud mental todo ser un humano tiene derecho a la dignidad y el Departamento de Corrección y Rehabilitación y los proveedores de salud de Physician Correctional, cuya responsabilidad es proteger la vida de aquellos que tiene bajo custodia. Son los  responsables de lo que allí sucedió, debido al mal manejo de su personal y por no cumplir con su obligación de proveer servicios que ayuden a la rehabilitación moral y social de las personas privadas de su libertad.
•  No se realizó la evaluación psiquiátrica expedida por una jueza. Esto muestra una indiferencia deliberada a su necesidad de atención y tratamiento médico para su condición de salud, lo cual constituye una imposición de castigo cruel e inusitado, proscrita por la Octava Enmienda de la Constitución de los Estados Unidos.
• Al momento de su fallecimiento, se encontraba en el área de máxima seguridad sin haberle explicado el motivo de esta acción disciplinaria y sin haber cometido ofensa alguna.  Un paciente de salud mental no puede estar en aislamiento sin supervisión.

Es por esto que la familia de Shannel Colón Ponce exige:

1.      Justicia y un proceso de transparencia y comunicación abierta en el esclarecimiento de la muerte de Shannel.

2.      Que se apruebe un comité independiente para que investigue todo lo sucedido.

3.      Que pongan en vigor los debidos protocolos de seguridad de las leyes existentes que protegen los derechos de todas las confinadas.

4.      Que termine el uso de fuerza excesiva y castigos degradantes a las confinadas para prevenir muertes como la de Shannel Colón Ponce.

5.      Que la Comisión de Derechos Civiles exija a la Asamblea Legislativa que asigne los fondos suficientes para intensificar el mejoramiento de las instituciones penales.

Por favor, firme esta petición para dar a conocer el sufrimiento y las condiciones deplorables en las que viven las personas privadas de libertad en las cárceles de Puerto Rico y dejarle saber al Gobierno de Puerto que no vamos a tolerar que sigan ocultando evidencia de los crímenes que cometen con las confinadas en Puerto Rico.

"I don't think I can get out of here alive!" were the last words Shannel said to her Aunt Laura during the only visit she received on May 25, 2022. Eight days later, on June 2, 2022, at just 23 years old, our beloved Shannel suffered a violent death through an alleged "suicide" in the Bayamón Women's Prison in Puerto Rico.

No words can describe the pain, anger, and damage our family suffered by losing Shannel, a mental health patient who also orphaned a four-year-old girl.

The secretary of the Department of Correction and Rehabilitation, Ana Escobar, has given many versions of what happened. However, everything needs to be more consistent and transparent. The authorities have only left us with more questions than answers since the arrest until today. No investigation has produced a concrete report that explains the truth. 

Finally, Governor Pedro Pierluisi has never responded to our request to form an independent committee to investigate what happened with her death, which is still in dispute. Organizations in the PARE Committee sent a letter to the Governor and Ana Escobar on June 10, 2022, requesting that the family have access to all the information about the circumstances in which Shannel died and that an external committee is assigned to investigate thoroughly. Unfortunately, Governor Pedro Pierluisi has yet to respond.

• Regardless of her mental health condition, every human has the right to dignity. The Department of Corrections and Rehabilitation and Physician Correctional health providers are responsible for what happened there due to the mismanagement of their staff and for not fulfilling their obligation to provide services that help the moral and social rehabilitation of persons deprived of their liberty. In addition, their responsibility is to protect the lives of those in custody.
• Department of Correction never completed the psychiatric evaluation issued by a judge. Not providing her with mental health treatment shows a willful disregard for her need for medical care and treatment for her health condition, which constitutes an imposition of cruel and unusual punishment, outlawed by the Eighth Amendment to the United States Constitution.
• At the time of her death, she was in maximum security. However, a mental health patient cannot be in isolation without supervision.

Shannel Colón Ponce's family demands:

1. Justice and a process of transparency and open communication in clarifying Shannel's death.

2. To approve an independent committee to investigate everything that happened to Shannel.

3. To put into force the due security protocols of the existing laws that protect the rights of all inmates.

4. End the use of excessive force and degrading punishments to inmates to prevent deaths like Shannel Colón Ponce.

5. That the Civil Rights Commission demand that the Legislative Assembly allocate sufficient funds to intensify the improvement of correctional facilities.

Please, sign this petition to help us publicize the deplorable conditions and suffering that inmates go through in the prisons of Puerto Rico. And to let the Government of Puerto Rico know that we will not tolerate the crimes committed against the inmates in Puerto Rico.
