On March 24th, 2022 Nicole was only charged with failure to stop & operating an improper vehicle. Both are only class 2 misdemeanors. Her total in citation fees was $265. She never had a hearing/court appearance due to it getting waived. We were told that the next highest charge COULD be reckless driving causing 2nd degree manslaughter. We were also told that it would be challenging to do so just because the “elements” of the crash don’t meet the requirements. Basically saying that since she didn’t have any mind-altering substances in her system at the time of the crash makes it harder to press a more serious charge. Another step we can take to help is writing a letter to the states attorney asking them to press charges. Another option is to file a wrongful death lawsuit Get the word out about the petition. The more signatures we get the more helpful it will be to convince the state and judge that she needs to have more serious consequences for her careless and fatal actions. My brothers LIFE is worth more than 265 dollars in court fees.
