Subject: Urgent Request for Investigation into Extreme Medical Negligence Death, Breach of Consent & Surgery by Unqualified Doctors or Suspicion of Human  Organ Trafficking.

 

Dear Sir,

I hope this letter finds you well, but I regret to inform you of a deeply troubling incident that occurred at Tata Motors Hospital, Jamshedpur, requiring your immediate attention, investigation and action.

On 5th Oct’23, my sister, Babita Rai(Roy), a healthy 42 year old government teacher, sought medical consultation with Dr. Shipra Sarkar regarding her health issues of abnormal bleeding and irregular periods due to Ovarian Cyst. 

Subsequently, Dr. Shipra Sarkar consulted with senior doctor Somnath Ghosh, and together they recommended surgical intervention for Babita's condition. 

With trust in Dr. Somnath Ghosh's expertise, both my family and the patient provided consent for the surgery to Dr. Somenath Ghosh.

Babita was admitted to Tata Motors Hospital on 7th Oct’23, for pre-operative tests, and Dr. Somnath Ghosh conducted a checkup on October 8. 

However, to our shock and dismay, on 9th Oct’23, the surgery was performed not by Dr. Somnath Ghosh, as expected, but by Dr. Shipra Sarkar and a team of junior doctors, without prior notification or consent from us. This disregard for transparency and informed consent is deeply concerning.

Tragically, during the surgery, a grievous error occurred, resulting in a perforation of Babita's intestine. Post-surgery, despite Babita's complaints of severe stomach pain and swollen belly, the medical staff dismissed her symptoms as mere side effects and administered sedatives, exacerbating her condition. 

It wasn't until her condition deteriorated significantly that the medical team acknowledged a complication had occurred during surgery, necessitating a second operation on 12th Oct’23.

Regrettably, despite the second surgery, Babita's condition worsened, and she was placed on a ventilator before succumbing to her injuries on 13th Oct’23. 

Shockingly, the hospital failed to provide adequate documentation or reports to our family, leaving us in the dark regarding the circumstances surrounding Babita's tragic demise.

This egregious series of events points to a clear breach of Trust and consent, delay issue and forgery of reports, medical negligence, and an utter lack of transparency on the part of the hospital staff. 

In light of these grave concerns, we urgently request a thorough investigation into the actions of the doctors and staff involved in this incident. 

Furthermore, we implore the board members to take swift and decisive action, including the revocation of licenses for those found culpable.

The loss of my sister, Babita Rai(Roy), has left our family devastated, and we seek justice to prevent such tragedies from befalling others. Your prompt attention to this matter is crucial in restoring trust in the healthcare system and ensuring accountability for those responsible.

Death by Extreme Medical Negligence or Human Organ Trafficking?

 

 

Details – 

 

Patient Name - Babita Rai(Roy), Age – 42, Sister’s Designation - Govt School Teacher. 

Gender – Female, Husband Name - Rajnish Kumar, Husband Employer - Tata Cummins. 

Location & City - Tata Motors Hospital, Jamshedpur, Fitness - Very Healthy. 

Previous History - No Previous Alignments or Chronic diseases (Diabetes, BP, Hypertension etc.) 

 

Daily Routine – 

 

Used to get up around 6 am and work till 11 pm. She used to cook food for the whole family, go to Government school due to work, do Household & Utensils cleaning, Tuitions, take care of father-in-law with Alzheimer’s and mother-in-law, etc. 

 

Character – 

 

Never shouted at anyone, friendly with everyone, Cared for everyone, and never gave negative responses or spoke rude to anyone. 

 

Treatment Diagnosis – 

 

Ovarian Cyst of 6cm by open surgery but laparoscopic was done. 

 

 

Serious concerns in this event:

 

·       The appointed Dr. Somenath Ghosh for surgery was absent on the day of operation and other junior doctors operated without patient or family consent. 

·       Operation time changed from 10 am to 12 afternoon.

·       Has anyone heard that Puri-Sabzi is served in any good hospital that too post-operation? It shows the shady state of affairs of the hospital. 

·       Babita complained of Swollen belly on 9th Oct’23 evening, stomach pain on 10th Oct’23 & Severe stomach pain on 11th Oct’23. She even told us and complained to the nurse that it was a little swollen belly at the left side of her stomach. But nurses and doctors ignored it fully.

·       Instead of finding the reason for swollen belly and such pain, Nurses and doctors said it was due to Gas and gave her injections for gas, pain, and sleep.

·       She had no bowel Or gas movement post-operation for 2 days. Even the urine output had reduced considerably. All these symptoms were ignored by the Doctors and Hospital team.

·       No initiative was taken to follow operating procedures of CT scan and Ultrasound post-operation to rule out any complications or injuries to organs during laparoscopic surgery. 

·       They didn't want her to tell anyone the pain status, so they gave her sedation.

·       On Wednesday 11th Oct she vomited for 4 times and again complained of severe pain. She was so helpless that she was suffering from severe pain morning to night, but neither the hospital staff nor the Doctors took note of it.

·       Dr. Shipra Sarkar made my brother-in-law understand that it was due to Gas. Being a layman, couldn't understand that stomach pain and no bowel movement indicated that there were complications with surgery which doctors and hospital staff ignored. 

·       On 12th Oct’23 Thursday morning, she started omitting and her BP became very low which was sometimes not readable manually. Then hospital staff and doctors shifted her to the ICU due to her critical condition and conducted tests like X-rays, ultrasound and CT scan. 

·       Then they came to know that during 1st laparoscopic surgery, they had damaged her sigmoid colon in the intestine (Bowel Injury). 

·       A corrective surgery was done to mend the perforation in her intestine but by then the infection had spread throughout the body and had begun infecting multiple organs simultaneously. 

·       It had become a case of "severe sepsis septic shock." Consequently, she was put on a ventilator. She lost her life on 13th October due to cardiac arrest.

·       Due to errors of judgement in the operation, a perforation/ bowel injury/ colon injury occurred in the patient's intestines, causing abdominal swelling, vomiting, and pain.

·       No Valid Consent taken for change of doctor for 1st surgery. It is assault on patient’s rights.

·       They announced dead around 7 pm on 13th Oct. These last 2 hours no one was allowed to see her in the ICU at all as we tried a lot which can be seen in CCTV surveillance footage. 

·       They were not ready share to any details like reports, etc, for online consultations with the best Doctors in India before her death and just trying to show they are cooperating.

·       Several days (17) after the demise, after considerable insistence, the hospital administration provided medical reports related to the treatment, revealing discrepancies in the information provided by the hospital management, relevant doctors, and nurses.

·       The incompetence and unprofessionalism displayed by the doctors throughout the case whether it was during the surgery or while ignoring the post-operative symptoms is uncanny.

·       We are unable to understand how a healthy person who had gone for surgery which is very common these days can lead to her death.

·       Why the doctors involved were not able to see the perforation during the surgery?

·       Why she was kept on sedation? Why were post-operative symptoms ignored?

·       It seems to me like a murder wherein doctors have taken out the important organs and damaged the sigmoid colon so that the patient dies due to infection without any suspicion on them.

·       From what I have come to know in the last few days, this pair of doctors has a history of septicaemia, and many patients who have undergone surgery under them have died in the same way. 

·       For some reason, the hospital's administration is adamant about protecting them. 

·       I request the authorities to take action. I would like expert doctor's opinions who are in the field of laparoscopic surgery, general open surgery, and gynaecology. There are lots of instances and similar incidents or coincidences.

·       The main reason to escalate is that I found many similar death cases like my sister's death. On enquiring about 2 doctors mainly Dr. Shipra Sarkar and Dr. Somenath Ghosh from all sources and specially medical community, we found through family contacts & social media that around 15 to 25 approx. similar cases of deaths or critical condition referrals of patients. 

·       Other doctors involved in the operation are Dr. Priyanka Kumari, Dr. Anindita Roy, Dr. Vinay, Dr. Abhishek, Dr. Sanjay Kumar, Dr. S L Srivastava and Dr. Arunima Verma. 

·       Request you to investigate deaths or critical referrals’ of surgeries from the last 2-3 years. Kindly investigate into details of deaths like, patients name, consultant doctor, duration of consultation, operating doctor, employee or relative name and his relationship with the patient, age, any previous medical history of alignments, the reason for admission in the hospital, operation details, and causes of deaths. 

·       There is something fishy about deaths and operations undergone. The Government has the resources to investigate the matter. Someone has to take the lead and investigate the basic details and look into if anything is suspicious or fishy about incidents.

·       Please request you look into the matter of my sister's unnatural death or murder by doctors of the hospital. Thrusting someone is honest and will do the needful investigations on my elder sister and other deaths in Tata Motors Hospital, Jamshedpur. I have a suspicion that human organ trafficking is involved in it. 

 

Missing Reports or Information Required –

·       Video of Laparoscopic Surgery as they have taken consent for videography and mentioned OT notes Camera inserted. Please share the Model no and Panel screenshot of Karl Storz Laparoscopic Surgical Camera Equipment used for Surgery to collaborate with the company. 

·       CT scan done on 12th Oct’23 was not provided to us and denied to be done. But as per the investigation sheet & my brother-in-law, it was done. Based on that they decided to repair the bowel or colon injury in 2nd surgery. CT scan report and film of 12th October not given. CT scan was done on 12th October as per medical documents given to us. 

·       Blood Lab Reports from 7th to 10th October 2023 are missing in all reports given to us. Do you mean to say that you have done surgery without the current blood lab tests?

·       High Protein Soft & Full Diet Details - Detailed Food Items were given to patient Babita Rai (Roy) from the 9th to the 12th of October 2023 morning.

·       Ultrasound Report and Film of 7th Oct’23. ( As mentioned in the CT Scan Report of 7th Oct’23 “to correlate with ultrasound”). If not done, then what was the reason for not doing it, and why did they refer to the old scan report?

·       Why does the Ultrasound Report say updated on 26th Sep’23 and X-rays report says updated on 21st Oct’23? What is the reason behind it? Why are the dates modified in reports as 21st Oct’23?

 

Huge Delay in Providing Medical Documents – 

 

·       I have kept mailing from 14th Oct’23 onwards to Ratanji sir and Chandra sir, Agencies & Government. 

·       Even Gyan Prakash ji, the younger brother of my brother-in-law had mailed on 17th Oct’23, 19th Oct’23 to Tata Motors Plant head – Ravindra Kulkarni & Hospital Administrator - Partha Mukhopadhyay, and 28th Oct’23. 

·       I have mailed to top management & board of directors in Tata Motors Hospital, Tata Cummins, Tata Group & Tata Motors on 31st Oct’23 for asking reports and explanation in detail. Why was the reports delayed in issuing when it was asked on 19th Oct’23 email? 

·       Me and my 2nd brother in law requested Dr. Somenath Ghosh and Dr. Sanjay Kumar in person on the 13th Oct’23 afternoon for give all documents related to surgeries and medications, so that we could consult the best doctors in India online. At that point of time, they accepted their mistakes and apologized also to us, plus agreed to provide all documents.

·       But when we approached ICU doctors for the same they denied it and took all time. Then member of parliament Mahato sir came to the hospital and spoke to all doctors to release all documents and they agreed again. 

·       The Hospital campus has CCTV surveillance, which can be retrieved and confirmed same as our visits and MP's visit. But after the MP’s Visit, they gave just 5 pages of documents and nothing else. 

·       It is the responsibility of the hospital to provide all relevant documents at the time of death or at the time of discharge or body handover to us on the 16th morning at the hospital. 

·       Hospital has violated the basic rights of patient as per Law, Indian Constitution, RTI, and NMC (MCI). It should have been provided within 72 hours of death or when we had requested it before 5 hours of death. This basic fundamental rights of information can’t be ignored by them. It is our basic right to information of medical records.

Final Summary -

• I need to know if my sister’s death is due to Extreme Medical Negligence or Human Organ Trafficking or Used as Lab Rats/Pigs for Experience or Training or Experiment?

• They have admitted Septic shock and Hypothyroidism in their medical records.

• There is something illegal or fishy going on inside the hospital?

• They are bound to give a laparoscopic video on 9th Oct’23, If not concealment which points to culpability of injury to the sigmoid colon, since the ovarian cyst was on the Right side.

• Negligence is giving oral feeds and also admitting abdominal pain in the case sheet. This is criminal negligence because after surgery if the patient has pain perforation of the bowel should be suspected. It was a small cut so they missed it in the live video.

• Criminal negligence as per expert doctors & when negligence leads to the death of the patient. Inadequate follow-up care, surgical errors, lot of missing details - there’s a lot of negligence.

• Bowel Perforation is a complication of surgery. Surgical Error Negligence for 2 days and post-operating monitoring negligence. This is negligence from the operating surgeon's side as they have left the patient on duty doctor and nurses.

• Get the medical documents examined by an expert in handwriting or forensics and the best surgeon and physician doctor.

• Medical documents speak a lot about inconsistencies, discrepancies, and alterations. Back-dated reports modified as it looks. Documents are forged as it seems as pages are inserted, comments inserted, and altered.

• The matter of gross medical negligence and untimely demise due to negligent treatment by the administration of Tata Motors Hospital and private doctors.

• We have consulted with few of best Doctors off the record in field of Surgery, as per them it is Negligence and we trying to get the same on record with some other Doctors.

• Sir, this entire incident is a case of medical negligence and violation of medical ethics, for which my sister Babita lost her life.

• I accuse, and consider Dr. Shipra Sarkar, Dr. Somanath Ghosh, and the Tata Motors Hospital administration guilty and demand primary registration of charges against them to bring about justice.

• Hence, I request you, sir, to impartially investigate the above incident based on the attached documents and other available information and take action against the guilty Tata Motors Hospital administration and the concerned doctors.

• I will pursue this my sister’s murder to public, forums, highest and lowest levels in government till I get answers, justice on it and culprits punished.

• Hoping there will be at least one person honest in whole system or government who will work for Justice.

Suggestion –

We people need a very Strict Central Agency Authority which Monitors, Audits, Reports and Investigates deaths or critical referrals after surgeries by Doctors and Hospital in India.

This way patient's family can choose Doctors and Hospitals for Surgeries on basis of death or Success Rates which should be live updates online from each and every hospital irrespective of government or private.

This will help with the Accountability of Doctors and Hospitals.

I have sent at least more than 500 emails to Prime Minister, PMO, President, President office, Home Minister, Home Minister office, Health Family welfare Minister, HFW office, Jharkhand Governor’s office, Chief Minister, CMO office, Consumer Affairs Minister, Jharkhand Police officers From DGP to DSP, District Deputy Commissioner of East Singhbhum, Central Bureau of Investigation, Enforcement Directorate, Intelligence Bureau, National Investigation Agency, Income Tax, National Medical Commission, Jharkhand Medical Council, National Organ Tissue Transplant Organisation, Indian Medical Association, National Human Rights Commission, National Commission for Women, Lok Pal, Indian Medical Association, Supreme Court, High Court, 5000 plus News & Social Media people, 700 Members of Parliament, Jharkhand & Central Government, Health & Consumer Department Officials & Ministers, Other Concerned Government Departments like Education, Labour, Law, Justice, Women Child Development, Corporate Affairs, Chief Justice of India, Supreme Court, NALSA, UNHRC, WHO, etc.

Online or Offline Grievance Complaints –

Medical Boards Findings -

There were 2 medical boards formed due to online grievance complaints. We submitted all documents and written statements with valid questions for investigations. Still their findings has not been shared with me at all.

One medical board was formed at Civil Surgeon, Sadar hospital, Jamshedpur, East Singhbhum.

We submitted all documents with written statements & valid questions for investigations. Still their findings has not been shared with me at all for more than 4 months.

Other medical board was formed at Jharkhand Health Directorate, Ranchi. We submitted all documents and written statements with valid questions for investigations. Still their findings has not been shared with me at all for more than 1 month.

Investigations Ordered but Pending –

Prime Minister office, President office, National Human Rights Commission, National Commission for Women, Women Welfare Ministry, Government of Jharkhand, Health Family Welfare Ministry, Consumer Affairs Ministry, National Consumer Helpline, Jharkhand Health Directorate, Jharkhand Health Ministry Department, District Deputy Commissioner of East Singhbhum, etc. Are pending list of investigations at various levels of Government department officials.

DSP ordered for FIR on basis of email complaint to DGP, Jharkhand Police but SSI of Telco Police Station refused to register FIR.

Central Health Ministry has ordered To National Medical Commission & National Organ Tissue Transplant Organisation to investigate and submit their findings.

National Medical Commission has ordered to Jharkhand Medical Council and Jharkhand Health Directorate to investigate and submit their findings.

Jharkhand Health Ministry Department has ordered to District Deputy Commissioner to investigate and submit their findings.

All these investigations are pending for more than 3 months of notices issued for investigation but no actions taken at on ground level implementation.

Now it seems to be me that I am staying in a different country which is owned by TATA where Indian Government like Central or State doesn’t rule at all for common people.
