The Issue

Why this is personal
Our children, Yasbirat Habtamu and Samir Suleiman Ali, were our world — bright, kind, and full of promise. We came to Canada for safety and fairness. Instead, we lost them in a tragic crash, and the systems we trusted have left us without justice.

This petition is for our children and for every family that could face the same heartbreak.

 What happened
On July 26, 2022, our children were killed in a violent crash at the Burnaby–New Westminster border.

A police vehicle was involved, driving 124 km/h in a 50 km/h zone.
The Independent Investigations Office (IIO) and OPCC concluded the officer had no legal or moral responsibility.
The driver who hit our children was convicted of criminal negligence causing death.
 
How the system failed
ICBC paid only $15,000 total as “Enhanced Care” death benefits.
The criminal driver’s vehicle was treated as uninsured, even though we had paid for uninsured/underinsured coverage up to $2 million.
ICBC told us that because we received the $15,000 benefit, we cannot access the insurance we paid for.
We asked ICBC for internal documents and transparency — they refused.
We went to arbitration — the arbitrator refused, saying the law is “clear,” even if it is unfair.
 
The result?
Police: cleared by IIO/OPCC.
Criminal driver: convicted but uninsured.
ICBC: denies coverage we paid for.
Legal system: provides a right to sue — but with no real insurance money behind it.

We lost our children. Then we lost justice.

 
What we demand
We call on the Government of British Columbia and ICBC to:

  1. Review police pursuit policies and independent investigations (IIO/OPCC)
  2. Fix the Enhanced Care law so families of criminal crash victims can access the coverage they paid for
  3. Provide full transparency from ICBC about how this system was designed
  4. Meet with victims’ families to listen and act
