The theologian was transferred one week ago from the Fleury-Mérogis prison where he had been held in preventive detention to a secure unit at the Pitié-Salpêtrière Hospital in Paris for health reasons. His legal counsel, Emmanuel Marsigny, told Reuters that he has written to the Paris prosecutor to demand that a communiqué be issued to “correct the fragmentary and inaccurate information being transmitted by the press” about his client. The letter requests the prosecutor’s office to bring an end what he termed “a campaign of disinformation incompatible with the respect for the presumption of innocence and the necessary balance between the rights of the parties.” “Details of the case that have already been presented by the press as fact or as confirmed are, in reality, contradicted by the ongoing investigation and by several of the witnesses cited by the plaintiffs themselves,” added Mr. Marsigny. Three women have thus far filed complaints against Mr. Ramadan in France. The first, Henda Ayari, a former salafist, has accused Mr. Ramadan of molesting her during a meeting of the Union des organisations islamiques de France (UOIF) in 2012. The second, a forty-year old convert to Islam who suffers from a handicap related to an automobile accident, has told investigators that she underwent sexual violence in a hotel room in Lyon in 2009. The third is a 45-year old former escort. A fourth women, in the United States, has charged the grandson of the Egyptian founder of the Muslim Brotherhood, Hassan al-Banna with sexual assault. Mr. Marsigny accuses the first two plaintiffs of lying when they declared that they did not know one another when in fact they had been in contact, he said. “When we asked the first one to describe the hotel room in Paris (where the acts are alleged to have taken place), she described a totally unrelated room,” he added. “It is claimed that the Lyon plaintiff has produced a medical certificate corroborating her allegations when the actual certificate affirms the exact opposite.” The plaintiffs are likewise attempting to strengthen their case. The two Rouen-based lawyers who had been representing the first two have been replaced by a team of three barristers headed by Francis Szpiner, and including the former UMP (now Les Républicains) François Baroin, a member of Szpiner’s legal firm. ***** *FRENCH LA DEFENSE DE TARIQ RAMADAN CONTRE-ATTAQUE PARIS (Reuters) - L'avocat de l'islamologue suisse Tariq Ramadan, objet en France de trois plaintes pour viols, a saisi jeudi le Parquet de Paris pour qu'il "rectifie" les "fausses informations" circulant selon lui sur son client, en particulier dans la presse. Le théologien a été transféré il y a une semaine de la prison de Fleury-Mérogis (Essonne), où il est en détention provisoire, à une unité surveillée de l'hôpital de la Pitié-Salpêtrière à Paris, en raison de son état de santé. Me Emmanuel Marsigny a déclaré à Reuters avoir demandé par lettre au procureur de la République de Paris de publier un communiqué "pour corriger les informations parcellaires et inexactes relayées par la presse" concernant son client. Il souhaite que le parquet fasse ainsi cesser "une campagne de désinformation incompatible avec le respect de la présomption d'innocence et le nécessaire équilibre des droits des parties". "Des éléments présentés par la presse comme acquis ou confirmés sont en réalité contredits par les investigations déjà réalisées et infirmés par certains témoins cités par les plaignantes elles-mêmes", ajoute Me Marsigny. A ce jour, trois femmes ont porté plainte en France contre Tariq Ramadan. La première, Henda Ayari, une ex-salafiste, accuse Tariq Ramadan de l'avoir agressée en marge d'un congrès de l'Union des organisations islamiques de France (UOIF) en 2012. La deuxième, quadragénaire convertie à l'islam, handicapée depuis un accident de voiture, a dit aux enquêteurs avoir subi des violences sexuelles dans une chambre d'hôtel à Lyon en 2009. La troisième est une ancienne escort-girl de 45 ans. Une quatrième femme a par ailleurs porté plainte aux Etats-Unis pour agression sexuelle contre le petit-fils du fondateur égyptien des Frères musulmans Hassan el-Banna. Me Marsigny accuse notamment les deux premières plaignantes d'avoir menti en affirmant qu'elles ne se connaissaient pas alors qu'elles seraient, assure-t-il, en contact. "Quand on demande à l'une de décrire la chambre d'hôtel à Paris (où auraient eu lieu les faits), elle décrit une chambre d'hôtel qui n'a rien à voir", ajoute-t-il. "On dit qu'il y a un certificat médical pour la plaignante de Lyon corroborant ce qu'elle dit mais le certificat médical dit l'inverse." Du côté des plaignantes, l'heure est aussi au renforcement des défenses. Les deux avocats rouennais qui assuraient la défense de deux d'entre elles ont ainsi été remplacés par une équipe de trois conseils autour de Me Francis Szpiner, dont l'ex-ministre UMP (parti devenu Les Républicains) François Baroin, membre du cabinet de ce dernier. He is speaking now because he believes he is being treated unfairly. • Lawyer has asked prosecutor to release a statement to stop those false allegations, so that only the true facts are spoken about. • Said that from what he has seen in the case file, the first two plaintiffs were lying about a certain number of things and that the media is already judging Tariq Ramadan solely on the plaintiffs’ allegations • Tariq Ramadan categorically denies ANY types of relations with the accusers. • The lawyer stated that simple allegations is not proof of guilt and that other personalities have been accused of the same crimes and are nonetheless still free. • The host and one co-host argued that the preliminary investigation had found enough evidence in the case to remand Tariq Ramadan on bail. The lawyer argued back that the preliminary investigation went too fast and questioned the credibility of the plaintiffs based on contradictions in their statements. • One co-host cited that a plaintiff produced texts, photos, and recordings…to prove “Marie’s” allegations. The lawyer dismissed this saying that the investigation proved she had no direct contact with Tariq Ramadan and that the other plaintiff’s own family had warned Tariq Ramadan about her, that she was setting a trap for him. He then asked whether or not “Innocent until proven guilty” is still the rule of law in France? • One co-host argued that he was remanded because he had several citizenships…the lawyer shot back that he came of his own free will to face the accusations in France and that running away would just mean that he was guilty. • The lawyer also mentioned Tariq Ramadan’s health conditions and the way the medical expert appointed by the court deemed him fit for jail without really checking him thoroughly…against the opinion of a number of other doctors. In fact the checkup only lasted 20 minutes! • The lawyer declared that two new medical experts have been appointed by the court on Feb 28, 2018 and haven’t been to the prison to check up on him yet. The lawyer was taken aback by this. • The host mentioned the third accuser… the lawyer replied that she was not any more credible than the others and pointed out inconsistencies in her statement. • He also drew attention the first two complainants knowing each other although stating the opposite to the investigators. They shared 4 phone numbers in common including Caroline fourest’s (long time enemy of Tariq Ramadan) and that no one is wondering why, looking directly at the journalists. • The lawyer stated that the investigators have not properly looked at the file and were too quick to judge. • He emphasized that Tariq Ramadan is not asking for any favors and just wants a fair trial. • The host showed another excerpt of prof TR’s video asking his supporters to keep calm and be patient and responsible… she added that prof TR has a lot of support on social media, mentioned the GO fund me campaign and the petition and one co-host added that some of the supporters are threatening the accusers and some of the journalists who are working on the case. • The lawyer said that this was a human reaction of people who think that Tariq Ramadan is being treated unfairly , that he himself didn’t approve but understood their attitude he also pointed out that Tariq Ramadan’s were also active and abusive online. • The lawyer finally asked: Is this the image of the French legal system that we want to project to the world? ************ RESUME DE LA VIDEO : ME MARSIGNY A L'EMISSION C A VOUS • L’avocat a affirmé qu’il a pu consulter le dossier et qu’il en a conclu que les deux premières plaignantes mentaient, se contre disaient et que les enquêtes préliminaires contredisaient leurs affirmations. Il a ensuite réaffirmé que le prof TR niait toute relation impropres avec elles. • L’avocat a commenté que de simples déclarations ne constituent pas la vérité, il rappela qu’un ministre faisait l’objet des mêmes accusations mais dans son cas la procédure judiciaire suivait son cours normal. • La présentatrice et l’un des chroniqueurs ont souligné que les juges d’instruction après examen du dossier avaient décidé du maintien en détention provisoire du prof. Ce qui signifierait qu’ils avaient jugé les éléments du dossier suffisamment crédible, l’avocat rétorqua que ce n’était qu’une enquête préliminaire et qu’elle avait été trop courte. Il releva ensuite quelques contradictions dans les déclarations des accusés. • Le chroniqueur affirma qu’une des plaignantes a produit des textes, des photos, des vidéos et des enregistrements à charge, chose à laquelle l’avocat a répondu que l’enquête avait démontré qu’il n’y avait aucune trace de contacts directs entre la plaignante et le prof. et que la sœur de l’autre accusée avait prévenu le prof. de ce qu’elle préparait un piège pour lui, de même son propre frère est prêt à témoigner contre elle. • Il posa ensuite la question de savoir si la présomption d’innocence était toujours une réalité en France, un des journalistes répondit que Tariq Ramadan était détenteur de passeports étrangers donc susceptible de s’enfuir… l’avocat rétorqua que Tariq Ramadan s’était mis de sa propre volonté à la disposition de la justice et que de toute façon s’il s’enfuyait cela signifierait qu’il était coupable. • L’avocat rappela que le prof. souffrait d’une sclérose en plaques confirmée par 9 différents médecins dont 4 français, cependant le médecin commis par le la cour d’appel de paris, après seulement 20 minutes d’examen a décidé qu’il était en état de rester en prison. Il rajouta que deux autres médecins ont été commis par la justice pour évaluer l’état de santé du prof. depuis le 28 février et n’ont toujours pas été le voir en prison. • Lorsque le cas de la troisième plaignante fut abordé, l’avocat répondit qu’elle n’était pas crédible en pointant certaines cohérences dans sa déclaration, il a aussi attiré l’attention sur le fait que les deux premières plaignantes contrairement à ce qu’elles ont affirmé se connaissaient et avaient 4 numéros communs dans leur répertoire dont celui de Caroline Fourest. • Il a réaffirmé que Tariq Ramadan ne demandait pas de faveurs juste une procédure équitable. • Un autre extrait de la vidéo du Tariq Ramadan fut diffusée dans lequel il demande à ses supporters de garder leur calme et d’être responsables, les journalistes confirmèrent alors que le prof. avait de nombreux soutiens sur les réseaux sociaux, en rappelant le succès de la campagne de levée de fonds en ligne et la pétition « libérez TR » et remarquèrent que certains des supporters proféraient des insultes et des menaces à l’encontre des plaignantes et des journalistes. L’avocat de dire alors que c’était une réaction humaine normale de gens en colère en raison du traitement, qu’ils estiment partial, dont le prof. faisait l’objet, qu’ils n’approuvaient pas personnellement mais comprenait leur attitude et termina en disant que le camp des accusés était tout aussi actif et agressif.
